It has been determined that A.Y., a court clerk working at the Ankara Courthouse, improperly issued a decision of "no grounds for prosecution" regarding certain suspects by using the prosecutors' UYAP passwords. It was found that the transactions carried out in exchange for material benefits were done without the knowledge of the prosecutors, and that false documents were fabricated to create the contents of the files.

A court clerk working at the Ankara Courthouse was found to have improperly issued "no grounds for prosecution" decisions regarding certain suspects under investigation by accessing the accounts of the prosecutors he worked with in the National Judiciary Informatics System (UYAP).

According to the information received, the Ankara Chief Public Prosecutor's Office initiated an investigation upon receiving a tip-off that A.Y., a court clerk working in the Terror Crimes Investigation Bureau, had carried out unlawful actions in investigation files in exchange for material benefits and had been "tracking files." The Chief Public Prosecutor's Office, which terminated the clerk's duties in the Terror Crimes Investigation Bureau, wrote to the Financial Crimes Investigation Board (MASAK) and the Revenue Administration to identify the suspect's actions and the individuals he acted with, and began reviewing notary transactions.

FILES REEXAMINED AND...

The Chief Public Prosecutor's Office re-evaluated the investigation files for which "no grounds for prosecution" decisions were made during the period A.Y. was in office and investigated whether unlawful actions were taken in files where no decisions had yet been made. As a result of the examinations, it was determined that A.Y. had accessed the prosecutors' accounts in UYAP and issued "no grounds for prosecution" decisions regarding certain suspects, and had carried out fraudulent actions to obstruct the oversight of the investigation prosecutor.

ALL UNLAWFUL DECISIONS WERE CANCELLED

The Chief Public Prosecutor's Office annulled all the unlawful decisions made by the court clerk and issued arrest and detention orders for these individuals. While some of the suspects were arrested, it was noted that arrest warrants for some individuals, who were found to be abroad during the investigation phase, remained in effect. It was learned that the suspect A.Y., who was arrested on charges of "abuse of office" and "forgery in official documents," confessed in his statement that he had carried out unlawful actions using the passwords of the public prosecutors without their knowledge and consent, and that he had approved the decisions himself.

HARMONIZED THE DECISION AND FILE CONTENT

The suspect also admitted that he created fake documents and files to eliminate the control and oversight of the responsible Deputy Chief Public Prosecutor and that he harmonized the decision with the file content.
