On May 5, 2024, citizens who saw an abandoned vehicle in the Dere village area of Kastamonu reported the situation to the 112 Emergency Call Center.
DECAPITATED BODY FOUND As a result of the investigations conducted by the Kastamonu Provincial Gendarmerie Command teams who arrived at the scene upon the notification, a decapitated body was found in the water channel in the area. It was determined that the body belonged to Adem Yeşilgil (48), who had been missing for 4 days. After a 4-day search, the gendarmerie teams also found Yeşilgil's severed head 2,200 meters away from where the body was discovered.
Adem Yeşilgil (48) 2 SUSPECTS ARRESTED Within the scope of the investigation initiated by the Kastamonu Chief Public Prosecutor's Office, gendarmerie teams detained Şerife K., Niyazi K., and E. Ö., who were identified as having committed the act. The individuals were arrested by the judicial authorities to whom they were referred. During the trial process, E. Ö. was released under judicial control measures.
"I LOST MY MIND, I LOST CONTROL" A case was filed against Şerife K., Niyazi K., and E. Ö. for the crimes of "damaging property, intentional murder, and armed robbery at night" at the Kastamonu Heavy Penal Court.
During the ongoing trial, the detained defendant Niyazi K. defended himself, saying, "I mentioned in the 6-page petition I submitted to the court in the previous hearing. When I fired at his hand, he cursed in an unacceptable manner. He showed me a photo of my wife, my psychology broke down; if he didn't have a phone in his hand, why would I shoot? I shot at his hand first to avoid killing him, I told him to 'get out of here.' They tested me with my family, my wife, and my honor. Adem and Şerife came at me together. I didn't know what to do. I shot at his hand. The lawyer says he didn't have a phone. If he didn't have a phone, how did he show me the photo? When I shot at his hand, the phone broke. Then I panicked and didn't know what to do with the gun in my hand. Subsequently, I continued to shoot in a mindless manner. I didn't intend to kill; he has a family, and so do I. I did everything I could to avoid killing. Why would I shoot at a person without a phone in their hand? When he showed me the photo of my wife, I lost my mind, and when he cursed at me, I lost control. I didn't know what I was doing; I shot without aiming."
"I'M SORRY" HE SAID AND OFFERED CONDOLENCES Continuing his statement, Niyazi K. said, "I was released from prison in 2022 and have not committed any crimes since. When he showed me a photo of my wife and then threatened my life, I had to shoot. Despite all this, I still didn't do anything. I seek your forgiveness; I am very sorry. Both my family and his family have been torn apart, and our children are left in the middle. I wish it hadn't happened; I wish it hadn't been experienced; I couldn't escape. Still, I didn't shoot to kill; I shot at his hand. I could have shot at his body at that moment, but I didn't. I am very sorry for this incident; I didn't want him to die. I offer my condolences to them from here. I am very sorry. I wish this incident had not happened. I seek your forgiveness."
"HE THREATENED ME WITH MY CHILDREN AND MY HONOR" The detained defendant Şerife K., defending herself in court, said, "Everything Niyazi said is a lie. He is lying. My uncle had neither a gun nor a phone. He had nothing. I was the one who was actually threatened. I had no knowledge of money or weapons. He threatened me with my children and my honor. I had videos with him; he threatened me with those. He took my phone and used it himself. He shot my phone with a gun so that no one could call or reach me, and I couldn't go anywhere. He said, 'You will say your phone broke; I will kill your children and your family.' Now he swears, saying, 'They showed me a photo of my wife.' I do not accept anything this man says. I wonder how I got involved with this man and how I met him; I am very curious why God has put me in this situation. I hate myself very much," she said.
The defendant E. Ö., who is being tried without detention, claimed that he was unaware of the murder and requested his acquittal.
"DNA OF ŞERİFE AND NIYAZI WAS FOUND NEXT TO THE SEVERED HEAD" The lawyer of the victim Adem Yeşilgil stated, "No matter how much Şerife denies her guilt at this point, she is involved in the incident. When looking at the DNA profile found next to the severed head, the DNA profiles of Şerife and Niyazi are present. Although Niyazi claims that he shot the victim, he describes it as a spontaneous event. First, he says he did not shoot, and then he says he did. This shows that he planned and intended to carry out this act. Regarding how the photo of the severed head was taken, it is seen that his phone ran out of battery and he took it with another phone, and they sent it to their own phones. The defendant Esat has assisted the others. By providing drugs to the other defendants, he encouraged Niyazi and Şerife and incited them to commit this crime. At this point, we request that he be punished. We request that the status of the aider be evaluated. Because there have been 44 communications over social media and 6 normal phone calls. This indicates that some things are not going normally. For these reasons, we request that he be punished for intentional murder with monstrous feelings at the highest limit."
AGGRAVATED LIFE IMPRISONMENT SENTENCES ARE SOUGHT The public prosecutor requested in his opinion that Niyazi and Şerife be sentenced to aggravated life imprisonment, while E.
Ö. requested his acquittal due to lack of evidence. The court panel decided to continue the detention of Niyazi K. and Şerife K. and postponed the hearing to a later date.
