The defendant, who is being tried for allegedly murdering his ex-wife Sözen Tutci and injuring his son, whom he believed was not his own, appeared before the judge for the first time. In his defense, the defendant claimed that his son committed the murder and that he was being framed for it.
On July 27, 2024, in the Gölcük district of Kocaeli, Mustafa Y. came to the house of his ex-wife Sözen Tutci and opened fire with a gun. The woman, who was the target of the bullets, fell to the ground in a pool of blood, while Mustafa Y. also shot his son Vedat Y. in the leg as he tried to intervene. Vedat Y. also fired at his father with a gun, injuring him.
DIED Upon receiving a tip-off from citizens, police and medical teams were dispatched to the scene. Medical teams determined that Sözen Tutci had died during their examination. After his treatment at the hospital, Vedat Y. was taken into custody and released under judicial control when he was brought to court in a wheelchair. Mustafa Y., who was seriously injured, was discharged after approximately one month of treatment at Kocaeli City Hospital. Mustafa Y., who was taken into custody, was arrested by the court he was brought to and sent to prison.
A LAWSUIT WAS FILED AGAINST FATHER AND SON A lawsuit was filed against Mustafa Y. for 'premeditated murder', 'attempted premeditated murder against a descendant', 'violation of the inviolability of the home', and 'possession and carrying of firearms and ammunition without a license'; against his son Vedat Y. for 'attempted premeditated murder against an ascendant'.
"MY WIFE MARRIED ME WHEN SHE WAS 1 MONTH PREGNANT, VEDAT IS NOT MY SON" The first hearing of the case related to the incident was held at the Kocaeli 4th High Criminal Court. The hearing was attended by the detained defendant Mustafa Y., the non-detained defendant Vedat Y., complainants, witnesses, and lawyers for the parties. Mustafa Y., who did not accept the charge of murdering Sözen Tutci, said, "Vedat is not my biological son. I was 15 years old when I got married. My wife was 8 years older than me and came to me when she was 1 month pregnant. Vedat started causing problems at home after he graduated from university. However, he wanted me to leave the house by saying that I was the one causing problems. I accepted and went to Mersin, where I got married. After a long time, I called my son Eyüp. Vedat took the phone from my son and cursed at me. He had last set a trap for his mother. He filmed his mother in the bedroom with someone else. Because of these incidents, I even jumped from the first floor, attempted suicide, and broke my legs," he said.
"VEDAT IS TRYING TO PIN THE MURDER ON ME" Mustafa Y., who said he came from Mersin to Kocaeli to confront Vedat on the day of the incident, stated, "I watched my ex-wife's obscene videos on the internet. There are 648 obscene videos. My son Sinan, who died in a traffic accident last year, had gifted me a gun. I took that gun with me to protect myself and came to Kocaeli. The reason I got the gun was that Vedat had previously threatened me with death. I had no intention of killing anyone. When I got home, Vedat assaulted me. To free myself from him, I only fired at Vedat 5 times. My wife took the gun and threw it from the balcony. When I asked what she was doing, she said she threw the gun from the balcony. Later, he shot me and his mother with the gun he had. I definitely did not shoot Sözen. The gun used by Vedat does not belong to me. If the gun were examined, my fingerprints would not be found. Why were fingerprints not taken from the empty casings? If they had been taken, Vedat's fingerprints would have been visible. Vedat is trying to pin the murder he committed on me. When I entered, Vedat pressed a gun to my throat, and I fired to protect myself. You need to release me," he said.
"I DID NOT SHOOT MY MOTHER" Vedat Y., who is being tried without detention for 'attempted premeditated murder against an ascendant', stated, "On the day of the incident, I was sitting and drinking tea with my mother. The doorbell rang, and when I looked through the peephole, I saw no one. When I opened the door, I saw Mustafa Y. with a gun in his hand. He fired 4-5 shots. I went inside and locked the door. When I heard that he was still shooting, I came out, and he made me and my mother kneel. He shot my mother in the chest. I jumped on him, and my mother ran to the balcony. He chased my mother. I took the gun that fell from him and fired randomly. I did not shoot my mother. She was not in my line of sight. She is paranoid because she is a drug addict and says I am not her son. I had no intention of killing Mustafa Y. I wanted to protect my mother and myself. He has threatened us many times. We could never get rid of him," he said.
"HE STAYED IN A HOTEL FOR 3 DAYS, HIDING IN THE GRASS NEXT TO THE HOUSE" Eyüp Y., a complainant who said he did not witness the incident, stated, "The person who has not learned humanity is lying. I wish none of us were his children, but unfortunately, we are. He has been saying since childhood that he was planning this. My mother is a person who has lived with honor and dignity. My father's statements about my mother are lies. Our only mistake was not killing him. As a result, my mother died. He stayed in a hotel for 3 days, hiding in the grass next to the house. He planned the murder," he said.
"WE HAD OBTAINED A RESTRAINING ORDER" Denying all his father's allegations, complainant Hasan Y. stated, "My father threatened my mother repeatedly by calling her. He made false accusations against her. My father has committed many acts of violence against us. What he says is a lie. We had previously obtained a restraining order against him," he said.
The victim's brother, Feyzettin Tutci, who was heard as a witness, said, "I have not spoken to Mustafa for 12 years.Elbette, mevcut HTML yapısını bozmadan metni İngilizce'ye çevirebilirim. İşte çeviri: ```html
He stated, "The claim that I gave a weapon to Mustafa and said something that led him to kill my sister is a lie." Mustafa's brother, Mahmut Y., did not want to testify.
The court panel decided to continue the detention of Mustafa Y. and to maintain the travel ban on Vedat Y., and adjourned the hearing.
