The Ministry of Justice has prepared a new draft that sets an upper limit on criminal sanctions related to unpaid alimony. With this regulation, the duration of coercive imprisonment will be a maximum of one year, and a prison sentence cannot be imposed for the same debt a second time.

The Ministry of Justice has prepared a new draft that foresees changes in the penal regulations regarding unpaid alimonies. The draft includes setting an upper limit for coercive imprisonment and preventing repeated penalties.

In addition to the discussions on indefinite alimony, the Ministry of Justice has re-evaluated the penal provisions regarding the collection of unpaid alimonies. The draft of the Enforcement Law, which has been opened to public opinion, introduces new limits for coercive imprisonment applied to alimony debtors.

SECOND IMPRISONMENT PREVENTION

Under the current practice, a debtor who fails to pay alimony can be sentenced to coercive imprisonment for up to three months. According to the new regulation, a person who receives this penalty cannot be sentenced to imprisonment a second time for the same debt.

TIME UPPER LIMIT

Additionally, the duration of coercive imprisonment to be applied in case the debtor fails to fulfill their alimony obligation cannot exceed a total of one year.

NO FINALIZATION CONDITION REQUIRED

According to a report by Türkiye Gazetesi, the draft also states that there will be no requirement for the court decision to be finalized in order to impose a penalty for non-fulfillment of alimony decisions. Accordingly, if an alimony debt arises after the finalization of the enforcement proceedings or if payment is not made in the following months, a coercive imprisonment decision can be issued.
