In the lawsuit filed for moral damages against Özgür Özel, Akın Gürlek's lawyer presented a petition to the court stating that the claim made by the CHP leader, "Istanbul Chief Public Prosecutor Akın Gürlek is a member of the board of directors at Eti Maden," is false. The petition noted that Gürlek was appointed to the position in question by the deputy minister and that he has not participated in any board of directors at Eti Maden since becoming chief public prosecutor.
CHP Chairman Özgür Özel claimed in his speech in Ümraniye that Istanbul Chief Public Prosecutor Akın Gürlek served as a board member of Eti Maden Company in Luxembourg. Akın Gürlek denied the allegation.

Gürlek, who filed a 500,000 lira compensation lawsuit against Özel, stated in the lawsuit petition submitted to the Istanbul Duty Civil Court that the plaintiff Gürlek was appointed to the board of the publicly owned "Etimaden - Etimine S.A." company during his tenure as deputy minister, but after being appointed as the Istanbul Chief Public Prosecutor, he did not participate in any board meetings of this company, did not sign any board decisions during this period, and therefore did not gain any profit.
The petition noted that the defendant Özel made accusations against Gürlek with a hostile attitude without researching this issue at all, damaging Gürlek's reputation and honor in a way that would harm him, stating, "While the names of judges and prosecutors who have signatures on many controversial decisions reflected in the public are unknown, the leader of the main opposition party systematically and intentionally attacked my client’s dignity, honor, and personality by making accusations in front of society and the media, exceeding the limits of criticism, reaching millions of people. This lawsuit has been filed in response to this. In order to compensate for the damage caused to my client's moral personality, it has become necessary to file this moral lawsuit."
