Businessman Ali Zeybek, who lives in İzmir, had a DNA test conducted in a private laboratory for his three children after his 8-year-old eldest son said, "You are not my father," following his divorce. In this test, he learned that his twins are not his, while his eldest son is also not his biological child. As a result, he lost the paternity denial case he filed because his ex-wife took their 1.5-year-old son to the DNA test instead of their eldest son.
Ali Zeybek, a businessman operating a restaurant, cafe, and market in the Karaburun district of İzmir, and also owning vineyards, daffodil fields, divorced his wife F.B., the mother of his 3 children, in 2020 due to irreconcilable differences.
"YOU ARE NOT MY FATHER"
Later, while he was meeting with his children, who were granted custody to their mother, he experienced a great shock when his eldest son H.E.Z, whom he named after his father, said, "You are not my father." Following this, Zeybek had a DNA test conducted in a private laboratory for his 8-year-old son H.E.Z and his 6.5-year-old twins Y.A.Z and A.Z. The test revealed that the twins were indeed his children, but he learned that H.E.Z was not his.
LOST THE CASE AFTER TAKING A SAMPLE FROM THE WRONG CHILD
According to a report in Sabah; experiencing a second shock, Zeybek filed a paternity denial lawsuit at the Karaburun Civil Court. In accordance with the court's decision, Ali Zeybek provided a DNA sample at the institution on August 26, 2024. However, F.B. waited for the return of the twins, who had been with their father all summer, to take H.E.Z for the DNA test. On September 18, 2024, instead of H.E.Z, she took her 1.5-year-younger son Y.A.Z to the Forensic Medicine Institution to obtain a DNA sample. Since the wrong child was tested, Ali Zeybek lost the paternity denial case.
NEW SAMPLES TO BE TAKEN
Following this, he consulted with lawyer Varol Turbay, who specializes in paternity cases. After reviewing the case, Turbay had his client identify the photo of the child from whom the DNA sample was taken at the Forensic Medicine Institution, revealing that it was Y.A.Z, not H.E.Z. Consequently, the İzmir Forensic Medicine Institution reported to the Karaburun Civil Court, requesting that new samples be taken when Ali Zeybek, F.B., and the children H.E.Z, Y.A.Z, and A.Z were together.
JUDGE MAY REPORT 'I WAS DECEIVED'
In a statement regarding the matter, lawyer Varol Turbay said, "The Forensic Medicine Institution stated in the report that new samples should be taken when the mother, father, and all three children are together. Additionally, they sent the report they prepared for the court based on our notification and made a report. The local court has not yet written the reasoned decision. If it is written, we will appeal. This will also be a first in Turkey. The court judge may report to the authorities due to being deceived before writing the reasoned decision," he said.
