PROSECUTOR DEMANDS 21 YEARS, 7 MONTHS, 15 DAYS PRISON FOR DEFENDANT
The prosecutor announced their opinion on the merits. The prosecutor requested that the 15-year-old defendant E.Ç. be punished with a prison sentence of 21 years, 7 months, and 15 days.
FROM THE INDICTMENT
In the indictment prepared by the Bakırköy Chief Public Prosecutor's Office, it is stated that on January 14, during an argument between two groups at a cafe on Mehmet Nesih Özmen Neighborhood Emek Street, the child pushed to crime (CPC) E.Ç. wounded the victim Atlas Çağlayan with a knife, and Çağlayan died at the hospital where he was taken.
In the indictment, a report from the Forensic Medicine Institute notes that E.Ç.'s ability to perceive the legal meaning and consequences of his act and to direct his behavior is sufficiently developed regarding the crimes of "intentional killing", "threatening with a weapon", and "violation of Law No. 6136".
The indictment states that Atlas Çağlayan's death occurred due to internal bleeding developing from a stab wound with a cutting and piercing tool, along with a vascular cut.
The indictment highlights that an examination of Çağlayan's phone revealed no evidence that he previously knew E.Ç. or that there was any animosity between them. It is reported that E.Ç.'s phone contained multiple photos of him holding a gun, individual photos of a gun, and photos of a knife.
The indictment evaluates that E.Ç.'s act of causing death by striking Çağlayan, who is considered a minor under 18, a total of 3 times in the vital areas of his chest and lower heart with a knife falls within the scope of the crime of "qualified intentional killing". It emphasizes that the knife used by E.Ç. in the incident falls within the scope of the crime of "violation of Law No. 6136".
"I'LL SHOOT YOU, I'LL RIDDLE YOU WITH HOLES"
The indictment states that E.Ç. carried out the threat act by pointing a knife at multiple victims in a single action. It notes that this person pointed the knife, considered a weapon, at victims D.Ç., Y.O.O, T.U.A., and R.O., and that his words and actions, such as "I'll shoot you, I'll riddle you all with holes. I'll kill you," are within the scope of the crime of "chain threatening with a weapon" in line with victim and consistent witness statements.
In the indictment, E.Ç. is requested to be punished with a total of 13 years and 6 months to 21 years, 7 months, and 15 days in prison for the crimes of "intentional killing against a child", "violation of Law No. 6136 on Firearms", and "chain threatening with a weapon".
