Striking details have emerged about former Minister Fatma Betül Sayan Kaya, who was arrested as part of the fund investigation. It was reported that three important pieces of evidence were reached in the investigation regarding the profit Kaya obtained from Özata Denizcilik shares. The allegations included phone calls, fund transactions exceeding 1 billion lira, and the transfer of money obtained from the share sale to the account without waiting for the normal settlement period.
Details of the process leading to the arrest of former Minister of Family and Social Policies Fatma Betül Sayan Kaya in the fund investigation in the capital markets have come to light.
Kubilay Gülbek, a columnist for Türkiye newspaper, wrote about three important findings on which the prosecutor's office focused. In the file, the transactions carried out through Özata Denizcilik shares, the phone traffic between the suspects, and the money transfers drew attention.
FIRST PIECE OF EVIDENCE: HTS RECORDS AND PHONE CONVERSATIONS
According to the information conveyed by Gülbek, it was determined that Kaya, who was arrested on charges of being a member of an organization established for the purpose of committing a crime and violating the Capital Markets Law, entered Özata Denizcilik shares with a 163 million lira investment.
Within the scope of the investigation, the communication traffic between Kaya and Tera Yatırım owner Emre Tezmen and Erdin Özel was examined. The phone conversations held between the purchase and sale dates of the shares and the HTS records became one of the important headings of the file.
Gülbek also reported that Kaya's name was mentioned in the statements of some people arrested within the scope of the investigation.
SECOND PIECE OF EVIDENCE: A TRANSACTION OF 1 BILLION 444 MILLION LIRA
The second detail that stood out in the file was the fund transactions carried out during the sale process of Özata Denizcilik shares.
According to Gülbek's article, Tera Yatırım purchased Kaya's investment fund of 1 billion 444 million lira through its own accounts. In this transaction, which was the subject of SPK and MASAK reviews, it was reported that the securities that should have been sold to other investors were collected in Tera Yatırım's fund named THF.
It was then stated that the securities in question were sold to investors at lower prices, and that on the same day Tera's THF and TP2 funds defaulted.
THIRD PIECE OF EVIDENCE: THE MONEY WAS TRANSFERRED TO THE ACCOUNT ON THE SAME DAY
The third detail that drew attention in the investigation was the method by which the money obtained from the share sale was transferred to Kaya's account.
While the normal settlement period for Özata Denizcilik shares is T+2, that is, two business days, according to what Gülbek reported, a different method was followed in the payment made to Kaya.
The profit Kaya obtained from the share sale was transferred to her account by wire transfer immediately after the sale using the T+0 method. The fact that the transaction was organized by Tera Yatırım stood out as one of the important connections examined in the investigation.
THE TRAIL OF 1 BILLION 344 MILLION LIRA IS BEING PURSUED
Another important heading of the investigation is the source of the 1 billion 344 million lira reportedly transferred to Kaya.
According to what Gülbek reported, it is being investigated from which sources Tera Yatırım obtained the said amount and through which transactions the money was transferred.
Thus, while three separate headings stand out in the file—phone records, fund purchases and sales, and money transfers—the assessment regarding the legal nature of the transactions will be made during the trial process.
