The Competition Board imposed a total administrative fine of 42 million 163 thousand 586 lira on the Cast Agencies Association and 36 enterprises for collectively determining agency commission rates and engaging in the exchange of competitively sensitive information.
The Competition Board has decided to impose an administrative fine of 42 million 163 thousand 586 lira on the Casting Agencies Association (KASTDER) and 36 enterprises operating in the casting agency and management sector.
42 MILLION LIRA FINE FOR CASTING AND MANAGEMENT AGENCIES
According to the announcement on the Competition Authority's website, the investigation into allegations that KASTDER and enterprises operating in the casting agency and management sector violated the Law on the Protection of Competition by jointly determining agency commission rates and service conditions, exchanging competitively sensitive information, and also by jointly conducting casting agency activities with casting directing and production activities has been concluded.
The Board decided to impose an administrative fine of 42 million 163 thousand 586 lira on the association and 36 enterprises that are parties to the investigation, on the grounds that the law was violated by jointly determining agency commission rates and service conditions and exchanging competitively sensitive information within the scope of the case file.
OBLIGATIONS IMPOSED ON ENTERPRISES
The Board also imposed obligations on the association and enterprises to ensure effective competition in the market.
Accordingly, casting directing and casting agency/management activities shall not be conducted jointly within the same economic entity. Enterprises conducting these activities jointly must remove one of these activities from their company's main contract and effectively terminate it.
Production, casting agency, and management activities shall not be carried out jointly within the same economic entity. Additionally, casting agencies and managers shall not engage in any other activity on behalf of the producer in the content for which they provide talent.
Enterprises conducting production, casting agency, and management activities jointly must remove one of these activities from their company's main contract and also effectively terminate it.
In negotiations between casting agencies, managers, and producers regarding the casting of talents, a talent's participation in content shall not be conditional on the participation of other talents.
KASTDER's structure shall be designed so that only enterprises conducting casting agency and management activities can become members. Association members shall be informed that casting directing and casting agency/management activities cannot be conducted jointly. Association members shall also be informed that production and casting agency/management activities cannot be conducted jointly.
Association members shall be informed that in negotiations between casting agencies, managers, and producers regarding the casting of talents, a talent's participation in content cannot be conditional on the participation of other talents.
