The draft law for regulations in the transportation sector has been approved in the Turkish Grand National Assembly. According to the law, individuals who operate unmanned aerial vehicles without obtaining flight permission and outside the areas determined by the General Directorate of Civil Aviation or local administrative authorities, and those identified by the general law enforcement forces, will be subject to an administrative fine of 60,000 Turkish Lira by the highest local administrative authority.

Persons who operate unmanned aerial vehicles outside the areas determined by the General Directorate of Civil Aviation or local administrative authorities without obtaining flight permission will be subject to an administrative fine of 60,000 Turkish Liras by the highest local administrative authority.

According to the Law on Turkish Civil Aviation, which includes regulations in the field of transportation and amendments to certain laws and decree laws, administrative fines to be imposed in case of non-compliance with the authorities and obligations in civil aviation will be increased.

In cases such as failure of commercial aviation companies to obtain permission and operating license from the Ministry of Transportation and Infrastructure, failure to notify changes in tariffs, failure to register Turkish civil aircraft, failure of civil aviation personnel to obtain qualification certificates, and failure of pilots to report crimes committed on the aircraft to the competent authorities, administrative fines ranging from 1,000 to 10,000 Turkish Liras will be increased from 20,000 to 500,000 Turkish Liras; and administrative fines ranging from 500 to 10,000 Turkish Liras for non-compliance with procedures related to the civil aircraft registry and issuance of registration certificates will be increased from 10,000 to 500,000 Turkish Liras.

INCREASED FINES

Those who fail to comply with the measures to be taken by the General Directorate of Civil Aviation in order to regulate civil aviation will also face administrative fines ranging from 500 to 10,000 Turkish Liras, which will be increased from 10,000 to 500,000 Turkish Liras. The import, sale, licensing, registration, certification of airworthiness, qualifications required for individuals using unmanned aerial vehicle (UAV) systems to be operated or used in the Turkish airspace, granting of flight permissions, and rules and principles regarding air traffic services will be determined by the General Directorate of Civil Aviation. Administrative fines ranging from 5,000 to 100,000 Turkish Liras will be imposed by the General Directorate of Civil Aviation on those who violate the regulations regarding the import, sale, registration, licensing, provision of airworthiness, and qualifications required for individuals using UAV systems.

60,000 LIRA FINE FOR FLYING UAVs WITHOUT PERMISSION

Persons who operate unmanned aerial vehicles outside the areas determined by the General Directorate of Civil Aviation or local administrative authorities without obtaining flight permission and are detected by the general law enforcement forces will be subject to an administrative fine of 60,000 Turkish Liras by the highest local administrative authority. In case the responsible operators and managers of companies selling unmanned aerial vehicles fail to register the information of the sold vehicles and the identity information of the buyers in the system of the General Directorate of Civil Aviation, and in case they fail to register the vehicles brought individually from abroad or taken over within the country in the system within 3 days, a fine ranging from 5,000 to 50,000 Turkish Liras will be imposed; and in case of false statements or data entry during registration, a fine ranging from 10,000 to 100,000 Turkish Liras will be imposed.

According to the law, no fee will be charged for permits granted for necessary facilities such as health, hotel, motel, restaurant, religious facilities, shopping units, fuel stations, logistics, cargo facilities, management and administrative buildings, temporary accommodation facilities, and terminal buildings within the boundaries of airports and airport projects in state forests to meet the essential needs of passengers.
