In Isparta, detained defendant Nafiz Gürbüz, on trial for killing 22-year-old İsmail Özdemir after arguing with him over allegedly harassing his fiancée, told the court, 'I have diabetes, I don't remember most of the incident,' expressing regret. The grieving mother, reacting to the defendant's defense, made a striking statement in the hearing: 'If you don't remember anything, how did you remember where the gun was?'
In Isparta, in the Modernevler neighborhood on 3103 Street, an incident occurred last July during the night hours. İsmail Özdemir (22) argued with Nafiz Gürbüz (35) on the grounds that Gürbüz had been disturbing his fiancée, Feyza Tanrıkulu. As the argument escalated, Gürbüz fired at Özdemir with a pistol he had with him. Özdemir was injured by bullets that struck his chest and heart. Medics dispatched to the scene upon notification took Ödemir to Isparta City Hospital, where he died. After the incident, Nafiz Gürbüz fled but was caught by police at a relative's house in the Çünür neighborhood. Taken into custody, Gürbüz was arrested.
İsmail Özdemir (22) "I CYCLED THE PISTOL" Nafiz Gürbüz, who was indicted for 'premeditated murder', appeared before the judge at the Isparta 2nd Heavy Penal Court in the second hearing. The hearing was attended by the defendant Nafiz Gürbüz, his lawyer and relatives, as well as İsmail Özdemir's mother İlkay, father Müslüm Özdemir, and their relatives. The presiding judge, noting that the defendant had refused to make a defense in the first hearing via SEGBIS and had requested to defend himself in person, gave the floor to the defendant for his defense. The defendant Nafiz Gürbüz began his defense by saying, "I have diabetes," and stated that on the day of the incident, he went out to eat something because his blood sugar had dropped, and during this time, a vehicle was following him. Nafiz Gürbüz said, "I was shot in 2018. I've been afraid ever since. When the vehicle followed me, I tried to lose it. When we reached the scene, I stopped, took the gun from the glove compartment of the vehicle, and got out. The person also got out and started coming toward me. I said, 'Friend or foe?' I cycled the pistol. The person approached, cursing. He said, 'I'm Feyza's fiancé,' and continued cursing. I said, 'You're not an enemy, go about your business.' Then I got back in my vehicle. I tried to close the door, but since I have diabetes, I didn't have the strength and couldn't close it fully. The person was holding the door. At that moment, in fear, I fired the gun in my left hand without aiming. Since the vehicle's windows were tinted, I didn't see him hit. If I had seen, I would have gotten out to help. Then I left the area. I regret it, I'm sorry."
İsmail Özdemir with his father "I AM VERY SORRY FOR THE INCIDENT" When the presiding judge asked, "It is claimed that you had feelings for Feyza and sent her numerous messages from various social media accounts, and that this led to the argument with the victim İsmail. What do you say?", the defendant Nafiz Gürbüz replied, "When they moved into the neighborhood, her mother entrusted her to me. There's nothing else. As for the messages, I can't remember whether I wrote them because I have diabetes." When reminded that he had admitted to writing the messages during the investigation, Gürbüz responded, "If I said so, it's true." The defendant Nafiz Gürbüz said, "I am very sorry for the incident. I apologize to his family."
"HOW DID YOU REMEMBER THE LOCATION OF THE PISTOL?" After the defendant's defense, the court panel gave the floor to the parties. The first to speak was the mother, İlkay Özdemir, who said, "I am a plaintiff and complainant against the defendant. I want him to be punished in the harshest way. Let him not apologize to me. Will apologizing bring my child back? He keeps saying, 'I don't remember this, I don't remember that.' If you're sick and don't remember anything, how did you remember where the gun was? If you had a problem with Feyza, why didn't you resolve it with her? What did you want from my son? You could have talked it out." The father, Müslüm Özdemir, also stated that the defendant was lying and demanded his punishment.
Mother İlkay Özdemir and father Müslüm Özdemir REQUEST SENT TO THE FORENSIC MEDICINE INSTITUTE Upon the request of the defendant's lawyer, the court panel decided to send a request to the Forensic Medicine Institute to investigate whether the diabetes mentioned by the defendant affected his ability to perceive the legal meaning and consequences of his action. Additionally, it was decided to obtain an expert report on whether the tints on the windows of the vehicle used in the incident obstructed visibility, and to have the camera footage from the time of the incident examined by an expert to determine whether the defendant continued his action with the weapon after the incident. The hearing was adjourned.
