Diyarbakır Bar Association President Abdulkadir Güleç stated that they will take the decisions regarding the Narin Güran murder case to the appellate court.

The trial regarding the murder of Narin Güran has been completed. After three days of hearings at the Diyarbakır 8th High Criminal Court, Narin's mother Yüksel Güran, her uncle Salim Güran, and her brother Enes Güran were sentenced to aggravated life imprisonment for "intentional murder of a child in participation," while their neighbors Nevzat Bahtiyar, who transported Narin's lifeless body to the stream, received a prison sentence of 4 years and 6 months.

BAR ASSOCIATION PRESIDENT GÜLEÇ: WE WILL APPEAL THE DECISION



After the hearing, Diyarbakır Bar Association President Abdulkadir Güleç stated in front of the courthouse that the court's decision partially met their demands and that they would take the decision to the appellate court. Güleç noted that the sentence given by the Diyarbakır 8th High Criminal Court was partially contrary to the indictment prepared by the prosecution, saying, "The Narin case, which has been closely followed by the public since August 21, has concluded today. The Diyarbakır 8th High Criminal Court announced its decision. The court sentenced defendants Enes Güran, Salim Güran, and Yüksel Güran to aggravated imprisonment for intentionally killing a child in participation. Nevzat Bahtiyar was sentenced to four years and six months in prison for tampering with evidence. Therefore, the court's decision was partially in line with our request. We can also evaluate it as a partially contrary decision to the indictment. Our expectation regarding Nevzat, as understood from our statements, is in participation. We believed that he should also be punished under Article 82 of the Turkish Penal Code, considering that he was an accomplice in that crime. However, this did not happen. He only received a prison sentence of 4 years and 6 months for tampering with evidence. We will take the decision to the appellate court," he said.

"THERE WAS NO CONFESSION REGARDING ANY CRIME IN THE FILE"



Former Diyarbakır Bar Association President Nahit Eren, who spoke after Güleç, stated that despite all the negativities and reactions, they continued their legal struggle for justice for Narin and a fair decision. Eren conveyed that they did not expect such a decision from the court today, saying, "Unfortunately, there was no confession regarding any crime in the file. But I had explained to the court. If Nevzat killed, yes, he should have been punished as a murderer. Even if he did not kill, it is clear from our statements that he was the one who took Narin to that stream and hid her for 19 days. In my view, if our sense of justice is to be satisfied, then legally, Nevzat should also be punished for intentionally killing a child regarding Narin. Of course, we say this as legal professionals. Because we did not know at what minute or hour Narin was killed. In this respect, how can we be sure that Narin was dead when he took her there to hide? Therefore, I believe that the decision was incomplete regarding Nevzat. This decision will be appealed regarding Nevzat," he said.

"WE WILL CONTINUE TO FOLLOW UP"



Eren stated that since the first day of the case, there have been significant wounds in the conscience of the entire society, and they have advocated for everyone who contributed to Narin's condition to receive the punishment they deserve. Eren noted:



"We will continue to follow the legal process as we have until today. But I am sure that this case and the legal process in this case will require significant efforts from both the Grand National Assembly of Turkey and the political authority to prevent similar murders from happening again in Turkey. In this case, we have highlighted all the deficiencies in terms of investigation and law enforcement to ensure that children are not murdered in this way again in Turkey. This case has shown us that we need a healthier system and a healthier policy regarding child murders and femicides from both the government and the Grand National Assembly of Turkey. However, this case also had different gains. We have always said that for the first time in Turkey, a bar association has become a complainant in such a case file. It has been harmed by the crime. And we have seen how valuable and important it is for legal organizations, as well as investigation and judicial authorities, to work together to reveal the material truth and uncover the facts in such cases. We expect the courts and investigation authorities in other cities in Turkey to take this exemplary application from Diyarbakır as a precedent in all similar cases."

Eren, stating that "We must protect the children of this country and these disadvantaged groups," added:



"We acted with that responsibility. We never had the intention to confront the family or to take the family as a whole against us. We had taken our place in this case for Narin so that whoever is the murderer, whoever has caused this, and whoever has acted together receives punishment. I would also like to thank you, esteemed members of the press, for your interest in this case as a citizen. This intense interest at this hour actually showed us how aware and supportive the entire society is regarding this case, which is due to your interest as members of the press. This also demonstrated to us how valuable it is for us as a society to embrace this case as a whole."

THE DECISION HAS BEEN ANNOUNCED



The court panel sentenced the detained defendants, mother Yüksel, brother Enes, and uncle Salim Güran, to aggravated life imprisonment for the crime of "intentional murder of a child in participation" under Articles 37/1, 82/1-d,e, 53/1, and 63 of the Turkish Penal Code.

They decided to sentence them to separate aggravated life imprisonment in accordance with the provisions of the law.

Nevzat Bahtiyar was sentenced to 4 years and 6 months in prison for the crime of "destroying, concealing, or altering evidence."

The court panel, which decided to continue the detention of the defendants, did not apply any good behavior reductions in the sentences given to the 4 defendants.

WHAT HAPPENED?

The lifeless body of Narin Güran, who went missing on August 21 in the Tavşantepe neighborhood of the Bağlar district of Diyarbakır, was found in the Eğertutmaz stream on September 8. As part of the investigation conducted by the Diyarbakır Chief Public Prosecutor's Office, 12 out of 23 suspects, including mother Yüksel, brother Enes, uncle Salim Güran, and neighbor Nevzat Bahtiyar, were arrested.

The investigation against Yüksel, Enes, Salim Güran, and Nevzat Bahtiyar was completed, and an indictment prepared with a request for aggravated life imprisonment for the crime of "intentional murder of a child in participation" was accepted by the Diyarbakır 8th High Criminal Court on October 23. The trial of the defendants began on November 7, and the first hearing, which lasted 3 days, was postponed to December 26 with a decision to continue the detention of the defendants.

After the first hearing, the public prosecutor submitted a 14-page opinion to the court during the session break.
