Alaattin Kadayıfçıoğlu FAMILY REACTS TO VERDICT IN FRONT OF COURT After the verdict, the Kundakçı family reacted in front of the courtroom to the acquittal decision issued for Aleyna Kalaycıoğlu. It was known that the family wanted Kalaycıoğlu not to be released throughout the trial.
WHAT HAD HAPPENED? The incident occurred on the night of March 19 on Sıddık Street in Ümraniye’s Tatlısu Neighborhood. According to the allegation, rapper Vahap Canbay, a member of the Canbay & Wolker group, wanted to reconcile with his ex-girlfriend Aleyna Kalaycıoğlu, from whom he had separated about 20 days earlier on a television competition. Canbay asked his friend, footballer Kubilay Kaan Kundakçı, for help for this. An argument broke out between the group that went to the front of the music studio where Kalaycıoğlu was located and the other side.
GOT OUT OF THE VEHICLE AND OPENED FIRE After the argument, a person who got out of one of the 2 vehicles that arrived in the area opened fire on the parked vehicle in which Canbay and his friends were located. Kundakçı, who was seriously wounded, could not be saved despite the interventions performed at the hospital where he was taken. After the incident, 7 people, including Kalaycıoğlu, Kadayıfçıoğlu and singer İzzet Yıldızhan, were arrested. Yıldızhan was later released during the investigation phase. The Istanbul Anadolu Chief Public Prosecutor’s Office prepared an indictment against 10 defendants.
POSSIBILITY OF A “PLANNED ATTACK” IN THE INDICTMENT In the indictment, it was alleged that, according to security camera footage in the expert examination, Alaattin Kadayıfçıoğlu got out of one of the 2 vehicles that approached the victim’s vehicle and fired one shot. According to the footage, Kadayıfçıoğlu got out of the vehicle at 22:57:41, and a gunshot was heard about 3 seconds later. In the indictment, which drew attention to the existence of phone calls among the defendants before and after the incident, it was assessed that the attack might have been planned rather than spontaneous. In the indictment, life imprisonment was also sought for Aleyna Kalaycıoğlu and her mother Zuhal Kalaycıoğlu, who were alleged to have incited the killing along with Kadayıfçıoğlu.
Alaattin Kadayıfçıoğlu THE PROSECUTOR HAD REQUESTED HER RELEASE In his opinion on the merits announced on October 6, the prosecutor stated that there was no conclusive evidence that Aleyna Kalaycıoğlu and her mother incited the killing. Stating that there was no clear instruction directed at intent to kill in the phone calls and communication traffic, the prosecutor requested up to 1 year in prison for Kalaycıoğlu for the offense of “failure to report a crime,” and her release. For Kadayıfçıoğlu, life imprisonment was requested for “intentional killing” and imprisonment from 2 to 4 years for violation of Law No. 6136 on Firearms, Knives and Other Tools. Acquittal was requested for Zuhal Kalaycıoğlu, Bilal Kadayıfçıoğlu and İzzet Yıldızhan, while release under judicial control measures was requested for detained defendants Hüseyin Can Avcı, Mustafa Rece, Metin Kadayıfçıoğlu and Engin Taşkıran.
