Mahmut Han, a 65-year-old man from the Genç district of Bingöl, died during surgery due to a heart attack after falling from a horse and breaking his hip bone. His family has filed a compensation lawsuit against the private hospital and the doctor.
Mahmut Han (65), who fell from a horse and broke his hip bone in the Genç district of Bingöl, passed away due to a heart attack during surgery at a private hospital in Diyarbakır. The family filed a compensation lawsuit against the hospital and the doctor.
FELL FROM A HORSE, BROKE HIS HIP BONE
The incident occurred on October 28, 2024, in the Büyükçağ village of the Genç district. Mahmut Han, who fell from the horse and broke his hip bone, was taken to Bingöl State Hospital by his relatives. He was later referred to Selahaddin Eyyubi State Hospital in Diyarbakır for further examination and treatment, and from there to Dicle University Medical Faculty Hospital. When it was stated that the planned surgery was risky, the family applied to a private hospital in the city upon the recommendation of an acquaintance. Allegedly, after being told that the surgery could be performed without risk, the parties agreed on a fee of 235,000 TL. Han was taken into surgery on November 4, 2024. However, it was reported that during the surgery, a clot in the vein traveled to the lungs, causing him to suffocate and suffer a heart attack, leading to his death. It was also stated that the 235,000 TL paid for the surgery was refunded to the family after the death. Han's family filed a lawsuit against the hospital and the doctor at the Diyarbakır 2nd Consumer Court through their lawyers. In the lawsuit, 150,000 TL in material compensation was requested on behalf of Han's wife, Saliha Han, on the grounds of 'loss of support.'
"WE REQUEST AN INVESTIGATION PERMIT"
The family's lawyer, Musa Koç, stated that the investigation permit they requested regarding the hospital and the doctor should be granted as soon as possible, saying, "Both the private hospital and the relevant professor doctor claim that there will be no problems and that they have previously performed similar operations. With the confidence they provided, the family accepted the surgery in exchange for the fee. However, as soon as the scalpel was applied, the clot in the vein spread to the lungs. This caused suffocation and a heart attack. We believe that the culprits of this heart attack and death are the relevant hospital and the relevant professor doctor. Initially, our case continues on behalf of the deceased's wife, Saliha Han. We have also requested a criminal investigation against the hospital and the relevant professor doctor for the crimes of 'causing death by negligence' and 'possible fraud.' What is of utmost importance to us is that the investigation permit is issued as soon as possible. Because when the investigation permit is not issued, we cannot proceed with the criminal process. They have based everything on a legal ground under the consent form. However, these documents have not been signed independently. Therefore, we believe that the hospital exploited our clients' weaknesses and impaired their will. The money taken in advance before the surgery was refunded to the deceased's family due to the death occurring after the surgery. This situation is contrary to the ordinary course of life," he said.
