Four months after the post, a criminal complaint was filed against Kalfa by the artist's legal heir brother, alleging "violation of moral, financial, and related rights."

Truck driver Salim Kalfa, living in the city, shared a 1-minute video he recorded with his mobile phone camera from the balcony of his house in the Ayasofya neighborhood on June 15, adding the chorus music of the song 'Uy aha' composed by his beloved Black Sea artist Kazım Koyuncu for Trabzonspor 21 years ago, on his social media account.

REQUESTED 50 THOUSAND TL COMPENSATION

Four months after the post, a criminal complaint was filed against Kalfa by the artist's legal heir brother, claiming that he violated 'moral, financial, and related rights' under Article 71 of the Intellectual and Artistic Works Law, at the Trabzon Chief Public Prosecutor's Office. The complaint requested 50 thousand TL in compensation. Learning that legal action was initiated against him due to 'unauthorized and unlawful use without any permission or proof of ownership,' Salim Kalfa went to the police station where he was summoned and gave a statement.

Salim Kalfa expressed his love for Kazım Koyuncu and stated that he had no knowledge of copyright laws, saying, "On June 15, I shared a video of Ayasofya neighborhood along with a song belonging to Kazım Koyuncu on social media. I wanted to use this song because we love Kazım Koyuncu and it is associated with Trabzonspor. I love him, I didn't share it with any bad intention. They called me from the police. They said, 'You made a clip for Kazım Koyuncu's song.' They told me that publishing it on social media was not legal. A song that shouldn't be published wouldn't be on social media anyway. Apparently, there are copyright laws. I published it. I made a mistake or I didn't. Kazım Koyuncu's brother has complained that I 'shared the song.' I couldn't make sense of it," he stated.

Stating that the post did not have a commercial purpose, Kalfa said, "Do they need money? I don't know. A penalty of 50 thousand TL has been requested. We already share the songs of many deceased artists like Ferdi Tayfur and Müslüm Gürses. There are a lot of singers. Kazım Koyuncu is one of our people. I am proud of his songs. I never expected something like this to happen to me. I didn't encounter any restrictions or obstacles while sharing. Apparently, there is no problem. Kazım Koyuncu is someone who belongs to Trabzonspor and Trabzon. We learned that 40 people have been complained about in this way in Trabzon. It could be 40 thousand people across Turkey. It doesn't suit Kazım Koyuncu's family to file a lawsuit against 40 people in Trabzon. I am already a truck driver. I am someone who constantly shares on long trips. I didn't do anything for money. I didn't do it with bad intentions either. If I had made a bad post about him, they would be right. I love the man, I consider Kazım Koyuncu as my own," he said.
