In Ankara, 53-year-old civil servant Şeyma U. divorced her 55-year-old husband A.U. after claiming he had cheated on her, and one year later she remarried him. About 2.5 years later, Şeyma U., alleging that her husband had cheated on her again, filed for divorce a second time. The Family Court also found the woman justified in the second case, filed on the same grounds, and ruled that the couple should divorce. The decision passed through the higher courts and became final.
In Ankara, a woman remarried her ex-husband, from whom she had divorced on the allegation that he had cheated on her, and then was taken to court a second time for the same reason. Şeyma U.'s lawyer, Senem Yılmazel, said that a contested divorce twice with the same person for the same reason is a rare situation.
AN 11-YEAR MARRIAGE ENDED IN SEPARATION
Şeyma U., who works as a civil servant in the public sector, and A.U., who is a sales manager at a private company, married in 2006. The couple had 1 child from this marriage.
Eleven years later, in 2017, Şeyma U. filed for divorce, claiming that her husband had cheated on her. As a result of the contested divorce case, the Family Court found the woman justified and ruled that the couple divorce. The court also ordered A.U. to pay 125,000 Turkish liras in compensation. The ruling was upheld by the Court of Cassation in 2020.
THEY CAME TOGETHER AGAIN DURING THE PANDEMIC
One year after the divorce became final, the couple reconciled and sat at the marriage table for the second time.
Şeyma U.'s lawyer, Senem Yılmazel, recounted that the couple came together again during the pandemic. Yılmazel said, "In 2021, during the pandemic, they felt very lonely. Later, her husband insisted a lot, saying that he had learned from his mistakes and would not make the same mistakes again. The parties came together again and continued to live in the same house for about 2.5 years."
SECOND DIVORCE CASE IN 2023
In 2023, Şeyma U. filed for divorce for a second time, claiming that her husband had cheated on her again. Lawyer Yılmazel stated that her client contacted her again and said, "She told me that she had remarried her ex-husband and wanted to divorce again."
Noting that the same problems continued in the second marriage, Yılmazel said, "In fact, the people were the same, the reason was the same, but the time was different. We filed the second divorce case in 2023. The client's husband stated that he loved his wife and did not want to divorce. But he was not found justified by the court either. Because there was also evidence."
THE FIRST DIVORCE RULING WAS SUBMITTED AS EVIDENCE
Yılmazel stated that they submitted the final first divorce ruling as evidence in the second case. The Family Court, evaluating this ruling as well, found the woman justified in the second case too and ruled that the couple divorce. The ruling became final after passing through the higher courts.
"A SITUATION WE RARELY ENCOUNTER"
Emphasizing that the case was also extraordinary for them, Yılmazel spoke as follows:
"She divorced the same person a second time. This is a situation we rarely encounter. That is, marrying the same person a second time and divorcing for the same reason a second time, and both cases being contested cases, is a situation we rarely encounter.
