In June 2023, on the first day of Eid al-Adha, an incident occurred in the Orhangazi district of Bursa. N.T., who is paralyzed and lives alone, allegedly left her front door ajar for guests who would come to visit during the holiday because she could not hear and had difficulty walking. Noticing the situation, Serkan T. entered the house, introduced himself as a doctor, and said, "I will examine you." Allegedly, Serkan T. took advantage of the paralyzed woman, who believed his words, and sexually assaulted her under the pretext of examining her. SLAPPED THE RESISTING WOMANThe suspect, who slapped the woman after she reacted and resisted, asked N.T. for money. When he received a negative response, he rummaged through the drawers and cabinets in her house. Scared by the woman's screams, Serkan T. fled, while N.T. went to the police station with the help of her relatives, whom she called. The suspect, who was caught by the police and had a record of many crimes, was arrested, while N.T. passed away 15 days after the incident due to a brain hemorrhage. INDICTMENT FOR 3 CRIMESSerkan T., against whom an indictment was prepared for the crimes of 'sexual assault', 'simple injury', and 'theft of items kept in a building', claimed during the prosecutor's interrogation that while ringing doorbells to greet people for the holiday, he heard a voice from the open door of a house and that N.T. invited him in. He stated, "When I entered the house, I saw a woman around 70 years old sitting alone. This woman told me she had difficulty walking and invited me inside. I said to her, 'Are you sick? I am a doctor, I will examine you,' and I closed the curtains so that I wouldn't be seen from outside." 'I SLAPPED HER AND KISSED HER FACE'Serkan T. claimed that he entered the house with the intent to steal to find money for the medications he used for his psychological treatment, saying, "I said, 'I will examine you,' and I took off her trousers. When she said, 'What are you doing?' I replied, 'I am examining you.' I slapped the woman, caressed her legs with my hands, and kissed her face. I hugged her and covered her mouth with my hand so she wouldn't scream. However, I did not take off my own clothes at all. When the woman continued to scream, I asked, 'Don't scream, do you have any money?' She told me she had bought a sacrificial animal and had no money. At that moment, I searched the drawers in the house. When I couldn't find any money, I fled the house," he stated. CONVICTED OF 2 CRIMES, APPEAL COURT OVERTURNED THE DECISIONIn the case heard at the Orhangazi Criminal Court, Serkan T. was sentenced to 7 years for 'sexual assault' and 5 years and 3 months for 'theft by being locked in a place accessible to everyone.' He was acquitted of the charge of 'simple injury.' The appeal court overturned the decision because the defendant was connected to the hearings via the Audio and Visual Information System (SEGBİS). After the decision, the detained defendant appeared before the judge again, repeating his previous statements that he heard a voice from the open door of the house and that N.T. invited him in, claiming he entered the house with the intent to steal to find money for the medications he used for his psychological treatment. The court announced its decision, sentencing Serkan T. to a total of 15 years and 3 months in prison: 10 years and 6 months for 'sexual assault', 4 years for 'theft', and 9 months for 'violation of the inviolability of the home.' The court decided to release the detained defendant under judicial control for the charge of 'intentional injury.'
