In legal proceedings, advance payment for expenses and fee schedules have been determined.

According to the announcements published in the Official Gazette, the advance payment for expenses, arbitrator fees, and witness fee tariffs have been determined in legal proceedings. The advance payment for expenses for the plaintiff has been set at 400 TL, while witnesses will be paid between 100 and 150 TL.

The advance payment for costs in legal proceedings, the arbitrator's fee, and the witness fee tariffs have been published in the Official Gazette.

According to the advance payment tariff published in the Official Gazette, the amount of the advance payment to be deposited in the court's cash register when filing a lawsuit, as per the Law No. 6100 on Civil Procedure, has been determined to be the amount of the notification fee for five parties for the plaintiff, along with 400 Turkish liras for other transactions. The plaintiff will be required to deposit the advance payment indicated in the tariff in the court's cash register when filing the lawsuit. The advance payment will cover expenses such as all types of notification fees and postal charges. The unused portion of the advance payment will be refunded to the plaintiff after the judgment becomes final. If the plaintiff has provided a bank account number, the refund will be made electronically by transferring it to the account. If no account number has been provided, the expense will be covered from the advance payment and sent to the address via PTT centers and workplaces as cash on delivery.

ARBITRATOR FEE TARIFF PUBLISHED

According to the Law No. 6100 on Civil Procedure, in cases and matters handled through arbitration, if the parties cannot reach an agreement on the determination of the fee between the parties and the arbitrator or arbitration boards, or if there is no provision in the arbitration agreement, or if the parties do not refer to established rules or institutional arbitration rules in this regard, the amount of the fee to be paid to the arbitrator or arbitration board has been determined by the published tariff. Accordingly, the arbitrator fees will be applied as follows: for the first 500 thousand lira, 7% for a sole arbitrator and 8% for three or more arbitrators; for the next 500 thousand lira, 4% for a sole arbitrator and 7% for three or more arbitrators; for the next 1 million lira, 3% for a sole arbitrator and 6% for three or more arbitrators; for the next 3 million lira, 2% for a sole arbitrator and 4% for three or more arbitrators; for the next 5 million lira, 1% for a sole arbitrator and 2% for three or more arbitrators; and for amounts above 10 million lira, 0.1% for a sole arbitrator and 0.2% for three or more arbitrators. The president's fee will be calculated as ten percent more than the fee paid to each of the arbitrators. Unless otherwise agreed, the correction, interpretation, or completion of the arbitrator's decision will not require additional fees.

WITNESS FEES BETWEEN 100 AND 150 LIRA

According to the published notice, witnesses will be paid a fee between 100 and 150 Turkish liras proportional to the time lost due to their testimony. If the witness has had to travel to be present, travel expenses and accommodation and meal expenses at the location where they are called to testify will also be covered. The fees and expenses that should be paid to the witness according to this tariff will not be subject to any tax, duty, or charge.
