At the third hearing of the İBB case, the complainants were heard. Capacity AVM managers Alaattin Kameroğlu and Selahattin Özgül, Gül İnşaat partner Çetin Gül, and Abdi İbrahim Board Chairman Nezih Barut said that they were complaining about the defendants. It was stated that in Kameroğlu’s statement in the indictment, he claimed that they were asked for 5 million dollars.

In the first session of the third hearing of the case being tried in Istanbul, the complainants’ statements were taken. The businesspeople stated that the statements attributed to them in the indictment were still valid and that their complaints continued.

ONE COMPLAINANT DID NOT FILE A COMPLAINT

Bahattin Uçar, the first complainant whose statement was taken at the hearing, said he had no complaint against any of the defendants and no request to join the case.

ALLEGATION THAT HE SAID, “LET’S OPERATE THE CAR PARK TOGETHER”

Then the statements of Alaattin Kameroğlu, a shareholder of Capacity AVM and a member of its Board of Directors, were taken. In Kameroğlu’s statement in the indictment, it was stated that after Ayşegül Ovalıoğlu was elected Mayor of Bakırköy, they went to congratulate her as AVM management and conveyed their problems regarding the car park.

Kameroğlu further alleged in his statement that Ali Rıza Akyüz, Deputy Mayor of Bakırköy Municipality responsible for notices, invited them to the municipal building. Kameroğlu claimed that at the meeting Akyüz said, “Let’s operate the car park together; this AVM has been recouping its costs for 17 years, the municipality needs money, from now on work jointly with the municipality.” According to Kameroğlu, Akyüz also asked, “You gained 25,000 square meters here thanks to the zoning amnesty; what have you given to Bakırköy?”

ALLEGATION THAT “5 MILLION DOLLARS IN CASH WAS DEMANDED”

In his statement in the indictment, Kameroğlu recounted that at the second meeting they informed them they did not accept the offer. He alleged that Akyüz then told them that by opening the AVM they had caused all the local tradespeople to go bankrupt. Kameroğlu said he was told that lawyer Süleyman Atik had been authorized regarding the matter, and that their own lawyers met with Atik.

In his statement, Kameroğlu had said, “Süleyman Atik informed the lawyers that 5 million dollars were demanded and that he wanted this money paid in cash by hand. In line with the authorization we gave him, our lawyer firmly rejected this unlawful demand.”

At the hearing, Kameroğlu said his statements to the prosecution remained valid and, in response to the presiding judge’s question, “Does your complaint against the defendants continue?”, answered, “It continues exactly as before regarding Bakırköy Municipality.”

“BECAUSE WE DID NOT PAY THE MONEY, THEY IMPOSED A COMMITTEE FINE”

Çetin Gül, one of the partners of Gül İnşaat and the company’s representative in the management of shopping malls, also said he was a complainant. In his statement, Gül stated that he had never seen Akyüz and alleged that after Akyüz took office, he said, “For 17 years you have been collecting the rent here; from now on I will collect it.”

Gül said, “Then, of course, because we did not pay this money, they imposed a committee fine corresponding to that amount. Of course, we made this the subject of a lawsuit, the committee fine was annulled; that is all I have to say. I am a complainant.”

“A 197 MILLION FINE AND A DEMOLITION DECISION WERE ISSUED”

Businessperson and Capacity AVM Board Chairman Selahattin Özgül also said his complaint continued. Özgül alleged that the problems began during the term of former Bakırköy Mayor Bülent Kerimoğlu.

Özgül said, “I want to talk about the suffering that began and was perpetuated during Bülent Kerimoğlu’s time at Bakırköy Municipality. We submitted documents to the Istanbul Chief Public Prosecutor’s Office in both physical and digital form. They acted as if these had never been submitted. A 197 million fine and a decision to demolish the building, which is sound, were issued.”

Stating that he had reports showing the building was sound, Özgül said, “I have a report from two years after the building opened stating that the building is in order. We gave it to the municipality. Thank God, we have made it to today because everything of ours has been in order. I am a complainant against them. I will join the case.”

ALLEGATION OF 4 MILLION DOLLARS FOR AN OCCUPANCY PERMIT

Then the statements of Nezih Barut, Chairman of the Board of Directors and member of the Executive Board of Abdi İbrahim, were taken. The indictment had alleged that those who built the Rotana Residences project in Şişli were forced to pay money in exchange for an occupancy permit. According to the indictment, Nezih Barut, one of the partners in the construction, reached defendant Süleyman Atik, who is alleged to be a member of the organization, and Atik reduced the demanded money to 4 million dollars.

The indictment had alleged that the 4 million dollars demanded by defendant Resul Emrah Şahan in order to obtain the occupancy permit was delivered to Atik, and the permit was then obtained. Barut said at the hearing that his complaint regarding the incident continued.
