Interim decision in the Newborn Gang case! The defendants will remain in custody.

Interim decision in the Newborn Gang case! The defendants will remain in custody.

23.11.2024 18:41

In the case of the Newborn Gang, which provided unfair profits by transferring babies to affiliated hospitals in Istanbul and caused their deaths, the organization leader Fırat Sarı made his defense. The scandalous words of Sarı's lawyer made a significant impact in court. Sarı's lawyer stated, "Mr. Fırat's income is 400,000 TL, but his expenses might be 500,000 TL. He is receiving support from his family." The court, announcing its interim decision, stated that the defendants would remain in custody.

The first hearing of the case involving 47 defendants, including 22 who are in custody, accused of unfairly profiting by transferring babies to hospitals they have agreements with and causing their deaths through negligent behavior, continued on the 6th day.

CONTINUATION OF CUSTODY STATUS

During the hearing held in the conference hall of Bakırköy Courthouse, journalists and lawyers took their places. Fırat Sarı, who is referred to as the leader of the gang, made his defense. After Sarı's defense, the court announced its interim decision. The court decided to continue the custody status of the defendants.

"FIRAT SARI'S INCOME IS 400 THOUSAND TL BUT HIS EXPENSES ARE 500 THOUSAND TL"

While responding to the accusations against Sarı, his lawyer used scandalous statements. Sarı's lawyer argued that despite his client's monthly income being 400 thousand TL, his expenses were higher. The lawyer stated, "Mr. Fırat's income is 400 thousand TL, but his expenses might be 500 thousand TL. He receives support from his family. Questions regarding the money he receives from others are annoying questions. I also receive money from the employees in my office."

According to journalists Rojda Altıntaş and Emrullah Erdinç; the defense began with questions directed at Sarı by the presiding judge:

"I HAVE NO HOPE LEFT IN LIFE, I WANT TO TELL EVERYTHING"

  • Presiding judge: You are accused of "manslaughter through negligence," "qualified fraud," "establishing an organization for the purpose of committing a crime," and "forgery in official documents." What do you have to say about these?
  • Fırat Sarı: I have been exposed to the public for a long time. I told my lawyers that I do not want a strategy; I want to tell everything.
  • Mr. President, about 2 months ago, after the prosecutor's threat incident, my lawyers left as public reactions intensified. A while ago, two lawyers from my hometown came; they wanted to participate but said they were not ready. Since these events occurred, my only goal has been to do everything I can to reveal the material truth. That’s why I want to defend myself.
  • This is not something within the scope of the indictment; it has become a situation that affects the public, especially due to the threat to the complainant. I wanted to come here very much, but I have lost hope in life. Things have come to a point that is beyond imagination.
  • All my accounts should be examined. Sümeyye and Mehtap said yesterday that I owe them. I would take money to have money controls because they spend a lot.
  • Everything that makes a person valuable has been taken from me. I have become nothing.

"NO ONE KNOWS THE ORGANIZATION BETTER THAN ME"

  • I was born in Bingöl in 1975. I completed my primary, secondary, and high school education there. I entered medical school at the age of 17. I participated in a protest at the university, and for that reason, I spent 4-5 years in prison for being a member of an organization. I was present during the period when children aged 16-17 were on hunger strike. No one knows the organization better than me. Later, I separated and started to communicate with security forces. I had connections with the state until the FETÖ period.
  • I completed my compulsory service at Esenyurt State Hospital. It is a place where a doctor sees more than 100 patients a day. After my compulsory service, I started working at Reyap Hospital in 2018. Since I worked at Reyap Hospital, I had a background at Esenyurt Hospital.
  • Esenyurt is the largest district in Istanbul. There are many medical centers there. The socio-economic level of the public is low. For example, a pregnant woman only goes to the nearest medical center when she is about to give birth. You cannot predict the condition of a baby born to a mother. When the baby is in bad condition, they want to transfer it as soon as possible.
  • When I first looked at what a business is, it was not just for newborns; it included ENT, ophthalmology, and physical therapy. In fact, physical therapy is the department with the most businesses. When I looked at this path, I thought about whether I could do it, and that’s how I started.
  • You can ask me anything related to contracts; I will explain everything to you in detail. We met İlker Gönen. He also explained how we met. He was someone who loved to work like me.
  • During this operation, I received offers from many hospitals, including Hospital A, but I did not accept them by saying "We are busy." This is a situation that exists everywhere in private healthcare.

THE BUSINESS SYSTEM IN PRIVATE HOSPITALS

  • Why do hospitals want to operate? Let me explain that too. It is difficult to find nurses and doctors. The other issue is related to their salaries. There is a problem with nurses' salaries, which are generally just above the minimum wage. Despite the significant responsibilities they bear, the nurses being prosecuted work for slightly more than the minimum wage. When you pay someone a high salary, the balance in the work environment is disrupted.
  • On the other hand, there is a patient issue. I am in favor of private hospitals. These places care about human health but also want to make a profit. Proper management is also very important because even a small incident can escalate to terrible proportions.
  • Everywhere in Istanbul is a business. Many people did this job before me. The contract is referred to as a 'service cooperation contract.' With this contract, everything belonged to the hospital; doctors, nurses, etc., all operated under the hospital's own corporate system. I did not discover this system; it already existed.

"WE DID NOT TAKE PATIENTS BY BRIBING ANYONE AT 112"

  • I want to touch on transfers a bit. We received transfers from medical centers outside of 112. Otherwise, we did not take patients by bribing anyone at 112. If you call 112 today, the system responds with a button press.
  • The operation started in July 2023. After this date, you can obtain information on how many patients were transferred from 112. Moreover, the patient's relatives cannot decide where the patient will go.
  • There are more than 20 private hospitals on the European side of Istanbul. However, there are only 4 incubator ambulances at 112. What can you do in this situation?
Scandalous statements from Fırat Sarı's lawyer: Income is 400 thousand lira but expenses are 500 thousand lira

OBJECTED TO THE TAPES

  • I have many objections to the tapes. First, two people are talking. Here, I am speaking to the public, but I do not say everything; there may be a thousand things going through my mind, and I speak accordingly. You speak more comfortably to a person you trust.
  • Conversations that took place in private life were reflected to the public. These were not conversations related to the public. Additionally, certain parts were cut.

"EVEN MEMBERS OF PARLIAMENT WOULD CALL ME"

  • For the despised transfer system, even members of parliament would call me; everyone called. Because there was no space in the intensive care unit.
  • In the tapes, an impression was created as if babies were on the street from the conversation of two people.Here is the translated text with the HTML structure preserved, including translations for the `title` and `alt` attributes within the `img` tags:

    ```html
  • Those babies were in incubators, in hospitals where serious investments were made.
"MORTALITY RATES WILL INCREASE"
  • We were thrown into the fire with a report. Thousands of people working in those hospitals became unemployed. The healthcare system was disrupted. If the Ministry of Health teams are here, let them compare the mortality rates in Esenyurt, Beylikdüzü, and Avcılar before us. I think the mortality rates will increase.
  • I haven't watched the news for about a month. Even the sound of the news has become a trauma for me.
  • Yesterday, there was talk about Baby Karakoç. Newborns lose weight in the first week, but they return to their birth weight in the second week. On the other hand, being associated with Baby Kadan is a complete scandal. We are talking about the baby with İlker Gönen. This is a completely professional conversation.
  • Based on these conversations, it is claimed that Fırat Sarı and İlker Gönen are responsible for this baby's death. But the patient died one hour after birth.
  • There are very few pediatric intensive care units in Istanbul. God forbid, if something happens to one of our children, it would be very difficult to find a place.
  • I sleep for 2 hours at night, I visit hospitals all night. The police following me know this. In fact, they told me, "You never stop, you are always on the move."
  • In the report regarding the death of the opera baby, even the name of the hospital was mixed up. They examined my past patients and all CİMER complaints. When they couldn't find anything there, they turned to this place.
  • I no longer see myself as a human being.
  • Just as the judiciary is sacred, so is the medical profession. They come from the same root; physician, referee... How can I tell a physician, "Discharge the patient or don't?"
  • Nurse friends are young and very confident. While speaking, they always said, "I did this, I did that," but they are young. We were all like that when we were young.
"I TOLD THE MINISTRY OF HEALTH 'DON'T DO IT'"
  • My mortality rate is below the mortality rate of physicians in Turkey. If I were a murderer, this number would be high.
  • If a bribery allegation or news about you being a murderer comes out, the people you previously judged will have doubts. That's why I told the Ministry of Health, "Don't do it."
  • I am a simple person. They even told me about organ transplantation. They even brought up the issue of organ theft.
  • With these news, the traumas of mothers who left their babies in intensive care are revived. The mothers are right; I am not saying anything to them. They are also victims of this situation.
"THERE IS NO BABY DEATH IN THIS OPERATION, BUT THERE IS SOMETHING ELSE"
  • I had a friend who was an intelligence officer in Bingöl. He referred me to two police friends from the Homeland Security. I spoke with them for four hours, and I have the phone records.
  • When I said these things in the Financial Branch, everyone acted as if they had seen a ghost. What I explained to those police there was this: There is no baby death in this operation, but there is something else. These nurse friends work for minimum wage and tried to sell medicine for 300 lira.
"I THINK DENİZ KORKMAZ FILED A POLITICAL COMPLAINT"
  • As a result of the investigations, we learned that the person who made the complaint was nurse (male) Deniz Korkmaz.
  • I carried him like my own child. After making the complaint, he continued to work at Duygu Hospital. Deniz Korkmaz used to wear a Deniz Gezmiş jacket and read Mao during hospital breaks.
  • Deniz Korkmaz made his complaint saying, "My dear nation." But Deniz doesn't know such a thing; he is an extreme leftist. I think he has a relationship with Homeland Security; Deniz does not have concerns for the nation.
  • I think nurse Deniz Korkmaz did this as a political act. I cannot explain it any other way. We used to advise to keep this child separate from the organization, fearing he would go to the mountains or something.
"THEY CALLED MY SON AND SAID 'YOUR FATHER IS A GOOD DOCTOR'"
  • Today I received a letter from my son, who is 15 years old. In his letter, he says, 'I got a phone call, I was scared.' On the phone, they said, "Your father is a good doctor."
  • He explained that he was afraid to go to school. He couldn't say, "We can't say anything to anyone; my father always went to his patients and didn't care about us."
  • The only relationship I have built in life is a relationship of love.
"I MUST TELL THE TRUTH, EVEN IF GİYASETTİN FORGIVES ME."
  • Judge: Is Gıyasettin Mert Özdemir's wife here?
  • Fırat Sarı: We made his insurance.
  • Judge: He told a different story.
  • Fırat Sarı: Forgive me, but I must tell the truth; I made his insurance.
AGREED HOSPITALS
  • Judge: Which hospitals did you agree with?
  • Fırat Sarı: Doğa Hospital, it wasn't fully operational, but I worked with them for a while. First Baypark Hospital, then Florya Hospital, then Avcılar Hospital, then Şafak Hospital in Bağcılar, Güney Hospital, and Duygu Hospital.
  • Judge: Who did you meet for the businesses?
  • Fırat Sarı: I can't say I only met with the owners. But I also had meetings with the chief physicians.
"WHEN THERE WERE ASSASSINATION INCIDENTS AGAINST THE PROSECUTOR, THE COLOR OF OUR FILE CHANGED"
  • I spoke with the prosecutor. He told me, "I am not accusing you of the deaths." After that, when there were threats and assassination incidents against the prosecutor, I think the color of our file changed.
HE ANSWERED THE QUESTION WITH A SMILE: THIS IS REALLY A JOKE
  • The judge read the discussions about diploma usage and not going to work and asked a question.
  • Fırat Sarı: This is a joke, really a joke. (Laughing) We didn't use anyone's diploma. How could such a thing happen?
  • The point where the hospital administrations pressured me was to increase the number of patients. They were managers who didn't think about medical issues. They constantly told me to 'find patients.'
"I WAS PAYING 750 LIRA PER BABY"
  • I was paying Gıyasettin 750 lira per baby. His wife was working as an insured employee. Since he was a civil servant, we made the payments this way. I was also giving money to Hakan Doğukan. İlker Gönen was my salaried employee. Our agreement was initially made on a fixed salary basis. Later we said, "Let's be partners," but it didn't happen.
  • The money we received at our hospital was not money; it was a small amount. Give it to the doctor, give it to the nurse, give it to the ambulance driver, nothing was left.
  • Our interlocutors were the hospital authorities. For example, someone like hospital owner Ali Dirik. We were talking with Osman Hoca and Atilla Bey at Beylikdüzü Medilife Hospital. We discussed that everything in the hospital would be with the hospital's knowledge.
CONVERSATION RECORDS WERE ASKED
  • Judge: Do you have a conversation with Renas?
  • Fırat Sarı: The patient requested.
  • Judge: You have a conversation with İlker Gönen regarding the female baby.
  • Fırat Sarı: It was a dialogue.
  • Judge: There was a conversation that maybe if a tube was placed on the child, he would survive.
  • Fırat Sarı: You understand there. There is an action. There is no negligence there.
  • Judge: You intubated without taking a lung film.
  • ```
    If you have any further requests or need additional assistance, feel free to ask!```html
    • Do you remember this conversation?"
    • Fırat Sarı: There is no negligence there.
    • Judge: You say the hospital's revenue is decreasing.
    • Fırat Sarı: It's related to the step.
    • Judge: You say to Gıyasettin, "Come here."
    • Fırat Sarı: I said "Come look" because he didn't believe the patients we needed to discharge.
    • Judge: "They said let's start transferring nurses, or we will close it."
    • Fırat Sarı: The number of nurses does not decrease. But they have complained about Reyap Hospital.
    HE COULDN'T EXPLAIN THOSE WORDS: I DON'T KNOW
    • Fırat Sarı: Hasan Basri Gök (nurse) and Hakan Doğukan Taşçı (nurse) are the people who disrupted my relationship with İlker Gönen (doctor). These two kids systematically poisoned me. My temperament is calm; I am not someone who can hurt anyone. Friends know that too.
    • Judge: Ceren Hatice Kırım says, "They uncovered all kinds of irregularities, they interfered." What do you say?
    • Fırat Sarı: I don't know.
    • Judge: How come?
    • Fırat Sarı: I don't know.
    "MEDICATIONS WERE STOLEN"
    • Judge: There is a conversation between İlker Gönen and Mehmet Gürül. They say, "We will make the files compatible."
    • Fırat Sarı: This is something written to correct the deficiencies in the sheets.
    • Judge: Again, you have a conversation with Hasan Basri Gök. He says, "We dropped the medication today." You say, "Check the medications; you are going everywhere."
    • Fırat Sarı: Medications were being stolen. At first, they said Hüseyin Günerhan was stealing. Sümeyye Nur Arslan went, checked, and there was nothing missing. It turns out they (Hasan Basri Gök and Hakan Doğukan Taşçı) created such rumors to prepare the ground for stealing medications.
    "I ACTED FLEXIBLY TO REVEAL THE EVENTS"
    • Judge: You have a conversation with Hakan Doğukan. He says, "Did you not know that sales were written from the previous party (medication)?" You say, "No." Do you remember?
    • Fırat Sarı: I really didn't know. I didn't pressure them; I acted flexibly to reveal these events. I really saw that they were selling medications in the tapes.
    • Judge: Hakan Doğukan is talking to Hasan Basri. Again about the epicrisis?
    • Fırat Sarı: I have nothing to say about the conversation between the two of them.
    HE DESCRIBED THE "PULL THE PLUG" DIALOGUE
    • Fırat Sarı: None of the good deeds we did regarding the patients were added to the tapes.
    • No one is pulling the plug or anything. You get irritated when you hear this, and you are right, but these are just conversations. Moreover, I am being accused of keeping patients for a long time; why would I kill them?
    THE PROSECUTOR REACTED: DON'T GIVE EXAMPLES THROUGH ME
    • The judge asks Fırat Sarı about the laughter in the tapes and other conversations:
    • Fırat Sarı: For example, when judges and prosecutors are chatting professionally, don't you say, 'I took a head'? This expression is something like that. I wish it hadn't happened, but this is not intent; it's just talk.
    • Prosecutor: Don't give examples through us. At least don't give examples through me.
    "DOĞUKAN WOULD FIND OUR PRIVATE INFORMATION"
    • The judge asks Fırat Sarı about the tapes:
    • Judge: Is it related to Kaya Bebek and the subsequent inspection? Do you have any information?
    • Fırat Sarı: Nurse Hakan Doğukan Taşçı called me; he said, "I sent something on WhatsApp, did you check it?" I said I hadn't checked; I was on the road. When I looked after I finished my work, the images had been deleted. Doğukan told me about this incident.
    • It is strange that Doğukan was aware of this incident and was calling. Doğukan is an interesting kid. He would find our private information, our family information. He is a friend who knows about the case I was previously tried for and has connections with people from above.
    • Sometimes he would even mention my HTS records. A kid who says he is following us. He even has conversations saying, 'They will conduct an organization operation on Fırat Sarı.'
    HOW DID FIRAT SARI PROVIDE SERVICES TO HOSPITALS?
    The hearing continued after the break:
    • Member judge: You went and talked to the hospital. What service did you provide under the name of consultancy? Is it your responsibility to address the staff shortage?
    • Fırat Sarı: For example, there is no neonatologist in the hospital. It is difficult to find a neonatologist because your phone can ring at any moment, and no one wants to work. But we cannot say, "This doctor will be here, this one will come."
    • Member judge: So does the doctor change with the changing business?
    • Fırat Sarı: Sometimes it changes, sometimes it doesn't. A neonatology nurse asks for too much money; we give it through the business. When the hospital gives it, the work peace is disturbed.
    • Member judge: Is it the hospital's responsibility to find the medical staff for the neonatal intensive care unit?
    • Fırat Sarı: Of course, it is all their responsibility. For example, they have a biomedical unit. If something is broken, they deal with it. But since we are consultants, we are intermediaries.
    • Member judge: So what service are you providing? Who calls you when there is a problem?
    • Fırat Sarı: The chief physician calls, the responsible person calls.
    • Member judge: In what situation are you called?
    • Fırat Sarı: When there is a malfunction or a problem.
    • Member judge: What kind of issues?
    • Fırat Sarı: For example, if a nurse has not come to work, has not worked, or a doctor is about to leave.
    • Member judge: Do they call you to recommend a doctor?
    • Fırat Sarı: Yes.
    • Member judge: How do you have agreements with hospitals?
    • Fırat Sarı: Based on revenue.
    • Member judge: What about İlker Gönen?
    • Fırat Sarı: He receives a salary.
    • Member judge: Do you give anything besides the salary?
    • Fırat Sarı: We talked later, but we couldn't give it because we couldn't make a profit.
    • Member judge: How much was the salary you provided?
    • Fırat Sarı: The last time it could be 100 or 150 thousand for İlker.
    • Member judge: Does it change according to hospital sales?
    • Fırat Sarı: No, it is fixed.
    "THE MOTIVATION FEE GIVEN TO NURSES WAS FIXED"
    • Member judge: Did the motivation fee you gave to nurses change according to revenue?
    • Fırat Sarı: No, it was fixed.
    FROM THE INDICTMENT
    In the indictment, the defendants Fırat Sarı and İlker Gönen are requested to be sentenced to a total of 177 years and 6 months to 582 years and 9 months in prison for "manslaughter by negligence," "qualified fraud," and "establishing an organization for the purpose of committing a crime" ten times, and for "forgery in official documents" eleven times.
    For the defendant Gıyasettin Mert Özdemir, a prison sentence of 180 years to 589 years and 9 months is requested for "manslaughter by negligence," "unlawful acquisition of personal data," "fraud to the detriment of public institutions and organizations," "establishing an organization for the purpose of committing a crime," and "forgery in official documents."
    Similar prison sentences are also foreseen for other defendants.
