The Ministry of Environment, Urbanization and Climate Change sent a warning letter to municipalities with kindergartens. In the letter sent by the ministry to the governorships, it was stated that activities and educational activities included in the preschool education program were detected in places opened under the name of kindergartens affiliated with municipalities, and it was requested that the governorships warn municipalities about unauthorized educational activities and prevent the opening of new places.
The General Directorate of Private Education Institutions of the Ministry of National Education sent a letter to the Ministry of Environment, Urbanization and Climate Change, stating that during field inspections, places opened under the name of kindergartens affiliated with municipalities were found, and it was determined that activities included in the preschool education program operating under Law No. 5580 on Private Education Institutions were being carried out and educational activities were being conducted within this program and scope.
"MUNICIPALITIES ARE PROHIBITED FROM OPENING KINDERGARTENS"
In the letter, it was noted that with the decision of the Constitutional Court in 2007, the provision of the Municipal Law stating that "Municipalities can open preschool education institutions" was annulled, and it was requested that municipalities be warned about unauthorized educational activities, that the opening of new places be prevented, and that actions be taken regarding existing places in accordance with the law.
A LETTER WAS SENT TO THE GOVERNORSHIPS
Upon the letter from the Ministry of National Education, the General Directorate of Local Governments of the Ministry of Environment, Urbanization and Climate Change also sent the letter to the governorships where municipalities with kindergartens are located through provincial directorates and to the relevant municipalities for information. In the letter, it was reminded of the aforementioned letter from the Ministry of National Education, and it was requested that municipalities be warned about unauthorized educational activities to prevent activities contrary to Law No. 5580 and to ensure that actions are taken regarding existing places in accordance with the relevant provisions.
The letter from the General Directorate of Local Governments of the Ministry of Environment, Urbanization and Climate Change is as follows:
"In the letters sent to our Ministry's General Directorate of Local Governments by the General Directorate of Private Education Institutions of the Ministry of National Education, it was stated that during field inspections conducted by the ministries, places opened under the name of kindergartens affiliated with municipalities were identified, and it was determined that activities included in the preschool education program operating under Law No. 5580 on Private Education Institutions were being carried out and educational activities within this program were being conducted. Referring to the relevant legal provisions, it was also mentioned that despite the Constitutional Court's decision dated 24.1.2007 and numbered 2005/95, which annulled the section of the first paragraph (b) of Article 1 of Law No. 5393 'Municipal Law' stating 'They can open preschool education institutions; ...' on the grounds of being contrary to the Constitution, it has been observed that such places continue their activities and new places are being opened. It is requested that municipalities be warned about unauthorized educational activities to prevent activities contrary to Law No. 5580 and to ensure that actions are taken regarding existing places in accordance with the relevant provisions; I respectfully submit my information and request for necessary action."
