In the indictment prepared regarding the Newborn gang, which is alleged to have caused the deaths of emergency infant patients by transferring them to private hospitals they had agreements with in Istanbul, phone records between the gang leader, ambulance worker Gıyasettin Mert Özdemir, and employees of Private Duygu Hospital were also included. The hospital's lawyer, in a statement, denied the allegations and argued that they were not among the hospitals to which the gang transferred infants.

Every day, new developments are emerging regarding the "Newborn Gang" that has deeply shaken Turkey. While 47 suspects, who are alleged to have caused the deaths of emergency baby patients by transferring them to the newborn units of private hospitals they had previously agreed upon and gained unjust profits, face prison sentences ranging from 177 years and 6 months to 582 years and 9 months, it has been requested that the private hospitals be closed and their assets seized.

The approximately 1,400-page indictment also included dialogues between the suspects. As reflected in the indictment, dialogues between ambulance worker Gıyasettin Mert Özdemir, who is described as the gang leader, and employees of Özel Duygu Hospital addressed patient transfers without notifying 112. Özel Duygu Hospital stated that their name appeared once in the investigation file but argued that they were not among the hospitals to which babies were transferred by the gang.

"I WILL MAKE IT LOOK LIKE A PATIENT HAS COME ON THEIR OWN, IS THAT CORRECT?"

While the hospital's name was mentioned in a report made to CİMER, it was not included in the list of closed hospitals based on the evidence obtained from the investigation. Özel Duygu Hospital was added to the indictment due to some attempts by gang members to accept children without notifying 112. Detained Gıyasettin Mert Özdemir explains the method of accepting baby patients without notifying 112 to hospital manager Mehmet Burak Sezer and hospital employee Burcu Şahin Gül, to which Sezer asks, "I will make it look like a patient has come on their own, is that correct?" Özdemir tells Sezer to admit the patient through the emergency department and hospitalize them. In another conversation, Özdemir tells Sezer, "You don't have a newborn specialist, you can't bring a patient from outside." Sezer responds, "Should I say it's my outpatient?" The person described as the gang leader, Özdemir, replies, "No, it will look like they came to the emergency department."

"IF I GET CAUGHT, MY AMBULANCE WILL BE DISCONNECTED"

In another recording, Özdemir speaks with Burcu Şahin Gül, the manager of the hospital's private nursing unit. Gül tells Özdemir over the phone, "If I get caught because my ambulance is tracked by GPS, my ambulance will be disconnected, I need to report that my ambulance has left." Özdemir responds by stating that they have not reported anything to anyone. After their conversation, Gül mentions that she spoke with her manager and resolved the issue.

Lawyer İlknur Çavdar Kısacık, who made a statement on behalf of the hospital, claimed that despite detained defendant Özdemir explaining the methods of transferring patients to hospitals, they acted in accordance with protocols. Lawyer Kısacık also asserted that the hospital contributed to clarifying the incident by providing information as a witness, stating the following views in her statement:

"The flow of the conversations is different, and it will be understood that our hospital accepts patients in accordance with all protocols.... There is one record belonging to our hospital in the investigation file. In the in-depth investigation conducted based on this record, it has been understood that our hospital did not accept patients in this manner."

"HOSPITAL MANAGERS HAVE NOT BEEN INCLUDED AS SUSPECTS IN THE INDICTMENT"

Kısacık stated that the incident mentioned in the indictment was only about a patient transfer and that it was not as stated in the audio recordings in the indictment, meaning that they did not accept baby patients from 112 and did not accept any babies from the state. Additionally, the following claims were made in the statement:

"Özel Duygu Hospital has never received any baby transfers from the state, and technically cannot do so because it does not have a NEONATOLOGIST staff. In summary, Özel Duygu Hospital is not among the hospitals to which the gang transferred babies received from the state. In the investigation file, our manager Mehmet Burak Sezer has been heard as a 'witness.' Our hospital managers have not been included as suspects in the indictment.
