Following the Constitutional Court's annulment of the provision on indefinite alimony, President Erdoğan instructed that a new, fair model be prepared on the grounds that the first draft was insufficient, one that would not victimize women or men and would be based on the parties' social and economic conditions.
After the Constitutional Court (AYM) annulled the phrase "indefinitely" in Article 175 of the Turkish Civil Code, legal drafting efforts that began afterward entered a new phase. President Recep Tayyip Erdoğan instructed work be carried out to bring the issue of indefinite alimony to an equitable and permanent solution that takes all segments of society into account.
THE FIRST DRAFT WILL BE RECONSIDERED
In the first draft prepared earlier, proportioning the alimony duration to the marriage duration had been raised. In this context, the formula under consideration was payment of alimony for 5 years in marriages lasting up to 10 years, and for half the marriage duration in marriages exceeding 10 years. However, it was assessed that the current formula could create different hardships ranging from short marriages to marriages lasting many years. Thereupon, President Erdoğan requested that a broader model be created that would prevent women and men from suffering hardship and would fundamentally solve problems in family law.
BROADLY PARTICIPATORY WORKING MODEL
According to a report in Sabah; under the new approach, it is planned to obtain the views of women's associations, academics, legal experts, family court judges, and relevant public institutions. The Ministry of Family and Social Services is also expected to actively contribute to the process. In the new model to be developed, not only the marriage duration but also multifaceted criteria such as the parties' age, health status, ability to work, income level, and post-divorce economic conditions will be evaluated together.
THERE IS TIME UNTIL JUNE 30, 2027 FOR THE GNAT
In its decision dated June 4, 2026, the Constitutional Court annulled the phrase 'indefinitely' in Article 175 of the Turkish Civil Code, and the reasoned decision was published in the Official Gazette on September 30, 2026. With the High Court stipulating a 9-month postponement period for its annulment ruling, the Grand National Assembly of Turkey has been given time until June 30, 2027, to implement the new legal regulation.
