New details have emerged in the obscenity investigation carried out against 5 suspects, including singer Tuğba Ekinci and social media phenomenon Ahmet Yılmaz. While the statements given by the arrested Ekinci and Yılmaz to the police, prosecutor's office, and the judge have been reflected in the file, Ekinci's words, 'I guessed that it could constitute obscenity. But I still shared it,' have drawn attention.
Under the coordination of the Kızılcahamam Chief Public Prosecutor's Office, the details of the police, prosecutor's office, and judge statements of Tuğba Ekinci and Ahmet Yılmaz, who were arrested within the scope of an investigation conducted by the Ankara Provincial Police Department Public Order Branch Directorate for the crime of "obscenity" on social media platforms, have emerged.
In her statement to the prosecutor's office, Ekinci said that she anticipated that her pink bikini images could constitute obscenity, but she still made the post. Ekinci, who claimed that the substance she smoked in the videos was not cannabis but a cigarette, stated that she deleted the videos following reactions from her family.
Ahmet Yılmaz, who was detained within the scope of the investigation, admitted that the X account named "Melibendeli" belonged to him. Yılmaz, who said that the striking profile text on his account also belonged to him, stated that he made all the posts subject to the investigation, saying, "I regret these posts."
SIMULTANEOUS OPERATION IN 5 PROVINCES
Within the scope of the Kızılcahamam Chief Public Prosecutor's Office investigation numbered 2026/2009, a simultaneous operation was carried out in 5 provinces against individuals considered to have published obscene content on social media.
During the operation, Tuğba Ekinci, Ahmet Yılmaz, Ozan Rüzgar Dikici, Beren Akın, and Çağlayan Yıldırım were taken into custody.
Among the suspects, Tuğba Ekinci, Ahmet Yılmaz, Ozan Rüzgar Dikici, and Beren Akın were referred to the judge within the scope of Article 226 of the Turkish Penal Code and were arrested. A judicial control decision was made for Çağlayan Yıldırım.
Following the investigation, the details of the statements given by Ekinci and Yılmaz to the police, prosecutor's office, and criminal judgeship of peace were reflected in the file.
TUĞBA EKİNCİ: "I ANTICIPATED IT COULD CONSTITUTE OBSCENITY"
Tuğba Ekinci stated in her statement to the prosecutor's office that she repeated the statement she had given to the police earlier. Ekinci, who admitted that the person in the images shown to her wearing white and pink bikinis was herself, made statements especially regarding the video where she was wearing a pink bikini.
Ekinci, who claimed that the substance she smoked in the image was not a drug, said, "What I smoked in the video where I was in a pink bikini is definitely not cannabis. It is a cigarette."
Ekinci then used one of the striking statements of the investigation:
"I anticipated that these videos could constitute obscenity. But I shared them anyway."
The artist said that she removed the said images from her own account after receiving reactions from her family.
"I WAS EXERCISING" DEFENSE AT THE POLICE
In Ekinci's statement to the police, she was also asked about a video detected by the Cyber Crimes units and spread from another social media account.
Ekinci, who admitted that the images belonged to her, claimed that the X account where the video was detected did not belong to her. Stating that she shared the said video in the "story" section of her own Instagram account, Ekinci explained that the images were later copied by other accounts.
Ekinci stated that the post was not a post pinned on the main page but a temporary post called a "story," and said that she did not think the video she shot and shared contained elements of a crime.
Ekinci, who claimed that she was exercising at home in the video, also asserted that the white substance in the images was not a drug.
Ekinci explained that shortly after making the post, her family reacted, and upon this, she removed the video from her account. She also claimed that she did not earn any financial income from the said content.
SHE DENIED THE ACCUSATION IN COURT
Ekinci, who was brought before the judge with a request for arrest, this time did not accept the accusations against her.
Stating that the images subject to the investigation were short-term "story" videos, Ekinci claimed that an attempt was made to create a perception of obscenity by taking photos one by one from the videos.
Asking for all the images to be watched in court, Ekinci said, "I was exercising in the images, I had no intention of exhibitionism."
Also alleging that she did not earn money from the posts and did not mediate the spread of the images, Ekinci stated that her mother had a heart attack due to the process and requested her release.
AHMET YILMAZ: I EARN MY LIVING FROM SOCIAL MEDIA
Ahmet Yılmaz, the other arrested suspect in the investigation, explained in his police statement that he did not work at any job and earned his living through social media.
Stating that he earned income especially through TikTok and paid taxes for these earnings, Yılmaz stated that various accounts on YouTube, Instagram, TikTok, and X platforms belonged to him.
Yılmaz claimed that he managed the said accounts himself and that no other person made posts on his behalf.
"I MADE ALL THE POSTS"
Yılmaz's admissions regarding his social media accounts in his statement to the prosecutor's office drew attention.
Saying that the social media profile named "Melibende" belonged to him, Yılmaz also admitted that the photographs shown to him belonged to him.
Yılmaz, who stated that the X account with the username "Melibendeli" also belonged to him, was asked whether the statement in the profile section of the account, "Welcome all of you to my fantasy love, my dear," belonged to him.
Yılmaz confirmed that the said statement also belonged to him.
Regarding the posts subject to the investigation, he said, "I made all the posts you have shown me."
While Yılmaz claimed in his statement to the prosecutor's office that he did not think the posts could constitute obscenity, at the end of his statement he said, "I regret these posts."
HE SAID "I OPENED THE ONLYFANS ACCOUNT SO NO ONE ELSE WOULD TAKE IT"
Yılmaz's statement to the police also included explanations about his OnlyFans account.
Yılmaz, who admitted that he opened the OnlyFans account shown to him, however, claimed that he did not actively use the account. Saying that he opened the account to prevent the username from being taken by someone else, Yılmaz alleged that he did not actively share content there.
Explaining that his aim in social media posts was to share his daily life with his followers and maintain his audience, Yılmaz stated that he made live broadcasts on TikTok and YouTube.
Saying that gifts sent by followers were deposited into his account as income by the applications, Yılmaz expressed that he had no other job and earned his living from social media income.
Yılmaz also explained the reason for the statement "welcome all of you to my fantasy love, my dear" on his X account, claiming that it was not related to his real life.
He stated that he shares various photos based on imagination and uses his profile bio for this reason.
“I WOULDN'T SHARE IF I KNEW IT WAS A CRIME”
Ahmet Yılmaz also did not accept the accusations against him during his interrogation before the judge.
Yılmaz, saying that he would not have published the posts if he had known they constituted a crime, explained that he had previously acted, and currently produces content on TikTok and YouTube.
Yılmaz and his lawyer argued that the posts under investigation did not contain explicit genital images and therefore the crime of obscenity was not committed, requesting that the arrest request be rejected.
4 SUSPECTS ARRESTED
The Kızılcahamam Criminal Court of Peace, after evaluating that the images in the file, the nature of the posts, the existing evidence situation, and facts showing strong criminal suspicion were present, decided to arrest Tuğba Ekinci, Ahmet Yılmaz, Ozan Rüzgar Dikici, and Beren Akın separately.
Çağlayan Yıldırım, on the other hand, was referred with a request for judicial control after it was determined that his post was from approximately 3 years ago and its content was evaluated, and a judicial control decision was issued against him.
It was reported that the investigation conducted by the Kızılcahamam Chief Public Prosecutor's Office continues.
