The second hearing of the case involving 47 defendants who allegedly profited unfairly by transferring newborn babies to the neonatal units of private hospitals, leading to their deaths, began tumultuously. The lawyer of the gang leader, Fırat Sarı, argued that his client's statement was taken in violation of procedure. Although the lawyer resisted, he was forcibly removed from the courtroom by the police.

The hearing is being held in the conference hall due to the insufficient capacity of the Bakırköy Courthouse's 22nd Heavy Criminal Court. 26 detained defendants, including the doctor Fırat Sarı, who is alleged to be the leader of an organized crime group, as well as some defendants who are not in custody, complainants, and lawyers were present. The hearing, which started at 10:45 AM, continues with the statements of the defendants' lawyers. In yesterday's hearing of the Newborn case, the request of the defendants' lawyers to change the prosecutor was rejected by the Bakırköy Chief Public Prosecutor's Office.



FIRAT SARI'S LAWYER REMOVED FROM COURT



According to a report by NTV, the hearing, where the requests regarding the detention of the defendants would be heard, started with tension. Fırat Sarı's lawyer, who is said to be the leader of the organization, argued with the court panel. Sarı's lawyer claimed that his client's statement was taken improperly. The presiding judge reacted to these remarks. The lawyer, who was ordered to be removed from the courtroom, resisted the decision, prompting police intervention. The lawyer was forcibly removed.



BACKGROUND OF THE CASE



In the 1399-page indictment prepared by the Bakırköy Chief Public Prosecutor's Office, it is stated that the organized crime group led by the defendant doctor Fırat Sarı is managed by the defendant doctor İlker Gönen and 112 Emergency Call Center ambulance driver Gıyasettin Mert Özdemir. The indictment notes that the main purpose of the crime organization is to eliminate the 112 dispatch system of the neonatal intensive care units they took over and to ensure their occupancy, manipulate the patients' stages, and receive maximum payments from the Social Security Institution (SGK).



The indictment states that the condition of the sick babies was shown to be worse than it actually was, and their hospital stays were prolonged unnecessarily, resulting in high fees being charged from SGK and excessive payments being collected from some patients' relatives. It is reported in the indictment that instead of transferring sick babies to hospitals that would provide appropriate health services, they were admitted to hospitals chosen by the suspects, which were deemed profitable for the organization, and that most of the profits were shared with the defendant members of the organization who are health workers. The indictment emphasizes that the main goal was to obtain the maximum financial gain rather than improving the health condition of the babies.



PENALTIES SOUGHT FOR THE DEFENDANTS



In the indictment, a total of 177 years and 6 months to 582 years and 9 months of imprisonment is requested for defendants Fırat Sarı and İlker Gönen for "manslaughter by negligence" in the deaths of 10 babies, "qualified fraud," and "establishing an organization for the purpose of committing a crime," with 10 counts for the first two charges and 11 counts for "forgery in official documents."



Defendant Gıyasettin Mert Özdemir is also sought to be sentenced to imprisonment ranging from 180 years to 589 years and 9 months for "manslaughter by negligence," "unlawful acquisition of personal data," "fraud to the detriment of public institutions and organizations," "establishing an organization for the purpose of committing a crime," and "forgery in official documents." Similar prison sentences are also anticipated for 44 defendants, including 8 women, for related crimes. The indictment requests that legal entities responsible for obtaining financial benefits through "fraud" be subjected to specific security measures, including closure and confiscation of their assets.



As part of the investigation, the licenses of 9 hospitals in Istanbul and 1 hospital in Tekirdağ Çorlu have been revoked, and the babies and patients receiving treatment in these hospitals were transferred to public hospitals by ambulances. Additionally, those who threatened the prosecutor Yavuz Engin, who is conducting the investigation into the newborn gang, with death in his office have also been arrested.
