Eyüpsultan Municipality has become subject to enforcement due to a 90 million lira receivable from a company providing waste collection services. Lawyers and enforcement officers arrived at the municipality building in the morning and initiated the seizure process.
Eyüpsultan Municipality faced enforcement proceedings due to a 90 million lira receivable from a company providing waste collection services. Despite three months having passed since the end of the contract, the lack of any payment plan from the municipality prompted the creditors' lawyers and enforcement officers to take action.
SEIZURE PROCESS HAS BEGUN
The company that rents waste collection vehicles primarily for municipal services has initiated legal proceedings to collect its receivables. Teams that went to the municipality building in the morning started the seizure process. It was learned that the seizure process is ongoing within the municipality building.
"WE COULD NOT COLLECT OUR 90 MILLION LIRA RECEIVABLE"
The company's lawyer, Erdal Avcı, stated that in their response to the municipality's enforcement proceedings, they reported parking areas among the assets to be seized, saying, "My client provided waste collection services to Eyüpsultan Municipality, but we could not collect our receivable of 90-95 million lira. We requested meetings with the municipality multiple times, but we did not receive a positive outcome. Therefore, we initiated enforcement proceedings. We preferred not to put parking areas, which should be available for public use, up for sale. Instead, we came to transport movable assets to secure storage with a protective seizure process at the municipality building. We proposed a reasonable solution to receive a small amount in advance and to pay the remaining in installments, but our offer was rejected. We held discussions with the directors and tried to resolve this issue with the mayor and deputy mayors, but we did not achieve any results. For this reason, we are exercising our right to seize," he said.
"THERE IS A SERIOUS INJUSTICE"
Avcı, who stated that the company has been providing services to Eyüpsultan Municipality for years, said, "In the last tender, they increased the cost by reducing the number of vehicles by 30%. This situation is contrary to the Presidential Savings General Circular. Nevertheless, we participated in the tender and wanted to continue providing services, but despite our 20 years of experience, it is unacceptable that the fee we deserve has not been paid. The municipality's attitude has put my client in a difficult economic situation. According to municipal law, they cannot apply seizure to all assets, but we will continue to fight legally to collect the amount we deserve. There is a very serious injustice here. We are facing a situation where the municipality does not pay personnel salaries. We will take what is rightfully ours and continue our legal struggle," he expressed.
