The bill for the amendment of the Social Insurance and General Health Insurance Law and certain other laws has been approved by the Health, Family, Labor, and Social Affairs Commission of the Grand National Assembly of Turkey (TBMM). Accordingly, the revenues generated from family medicine services will be deposited into an account to be opened for this purpose in the revolving fund enterprises of provincial health directorates, and these revenues will be collected from services for which the Ministry determines the tariffs.

The Law Proposal for Amendments to the Social Insurance and General Health Insurance Law and Certain Laws was accepted in the TBMM Health, Family, Labor, and Social Affairs Commission.

With the proposal, amendments are made to the Social Insurance Law. Accordingly, the principles of insurance will be taken into account in ensuring retirement rights, and retirement processes conducted based on the tax reduction certificate for disabled individuals insured before October 2008 will be determined according to the loss of working capacity under the Social Insurance and General Health Insurance Law, and all applications will be carried out by the Social Security Institution (SGK).

HOSPITALS WILL BE ABLE TO PROCESS PERSONAL DATA

In line with the Constitutional Court's annulment decision, a new article titled "Authority to collect, process, and share information" will be added to the Basic Health Services Law.

Accordingly, individuals applying to public or private health institutions and health professionals for health services will have their personal data processed, which they are obliged to provide as required by the health service or related to the service provided to them.

The Ministry of Health will be able to collect and process the obtained data for the provision of health services, protection of public health, preventive medicine, medical diagnosis, treatment, and care services, as well as for planning health services and calculating costs. These data cannot be transferred outside the conditions stipulated in the Personal Data Protection Law.

A system will be established to allow access to the collected and processed personal data by the individuals themselves or third parties they authorize.

The standards regarding the security and reliability of the established systems will be determined by the Ministry in accordance with the principles set by the Personal Data Protection Board. The Ministry will take necessary measures to ensure the security of personal health data obtained in accordance with the relevant legislation. For this purpose, a security system will be created that allows for the auditing of which authorized personnel used the registered information in the system and for what purpose.

THE DURATION OF THE TRADESMEN'S AHI FUND IS EXTENDED

Public institutions and organizations employing health personnel, as well as private legal entities and individuals, will be obliged to report the personnel they employ and personnel movements to the Ministry.

The processing and security of personal health data will be regulated by the regulation enacted by the Ministry.

With the regulation in the Unemployment Insurance Law, the effective date of the Tradesmen's Ahi Fund, which is currently December 31, 2024, will be changed to January 1, 2028.

IMPORT PERMIT FOR MEDICAL PRODUCTS

With the amendment to the Public Procurement Law, human medical products deemed necessary for general health insurance holders and their dependents, which cannot be provided domestically, will be procured from abroad with the approval of the Ministry of Health and delivered to patients by SGK.

INCOME FROM FAMILY MEDICINE SERVICES WILL BE TRANSFERRED TO THE REVOLVING FUND

With the amendment to the Family Medicine Law, services provided to foreigners, traditional and complementary medicine practices offered outside working hours, and family medicine services, except for those determined by the Ministry, will be free of charge.

Family medicine services will be provided within the framework of the criteria determined by the Ministry, at the request of the relevant family physician, and within the working hours approved by the local health administration, provided that they are not less than 40 hours a week, except in emergencies.

Income collected from services for which tariffs are determined by the Ministry will be deposited into an account to be opened for this purpose in the revolving fund businesses of provincial health directorates. The criteria for spending the income collected in this account for health service provision, including the amounts that can be distributed to the family physician and family health workers, as well as other procedures and principles regarding distribution and expenditure, will be determined by the Ministry with the approval of the Ministry of Treasury and Finance.

Data sharing will be possible with the funds established for the personnel of SGK, banks, insurance and reinsurance companies, chambers of commerce, chambers of industry, stock exchanges, or unions they have established.

DISABILITY STATUS UPDATED AGAIN

With the amendment to the Social Insurance and General Health Insurance Law, the daily earnings that will be the basis for calculating the allowances to be paid in cases of work accidents, occupational diseases, illness, and maternity will be based on the earnings from the 12 months prior to the date of the work accident or birth; in the case of occupational diseases or illness, it will be based on the date when the incapacity to work began. The daily earnings that will be the basis for calculating the income to be granted in cases of work accidents and occupational diseases will be calculated by dividing the total earnings subject to premium in the last 3 months of the 12 months prior to the date of the work accident or the date when the incapacity to work began by the number of days of premium payment related to these earnings.

However, for those who have reported less than 180 days of short-term insurance premiums in the previous 12 months, the daily earnings amount to be taken as the basis for temporary incapacity allowance cannot exceed twice the lower limit of daily earnings subject to premium on the date when the incapacity to work began.

This article will come into force on the date of publication of the law, effective from December 21, 2024.

FOREIGN STUDENTS' ACCESS TO GENERAL HEALTH INSURANCE

Foreign students can become general health insurance holders if they apply within 3 months from the start date of any academic year, provided that their registration continues.

International students who are granted scholarships by the Presidency for Turks Abroad and Related Communities or the International Students Evaluation Board will be considered general health insurance holders during the periods their scholarship status continues. The general health insurance premiums will be 4% of the determined lower limit of earnings subject to premium.

REGULATION FOR CLINICAL RESEARCH

The proposal will lead to regulations aimed at increasing the number of clinical trials. Accordingly, the continuation of the social security and health rights guaranteed by the Constitution for patients participating in clinical research conducted in public hospitals and state universities, which are permitted and approved by the Ministry of Health, will also be ensured during the clinical research process.

With another amendment to the Social Insurance and General Health Insurance Law, the participation fee for outpatient treatment for physician and dentist examinations will be 20 lira. SGK will be authorized to reduce the participation fee in health services by up to half for those referred by primary healthcare providers.

The 5-point insurance premium discount provided for the disability, old age, and death insurance premium that private sector employers will pay to SGK will be applied as 4 points.

With the proposal, the payment periods of the premiums under general health insurance for foreign students who are granted scholarships by the Presidency for Turks Abroad and Related Communities or by the decision of the International Students Evaluation Board, those who are doing legal internships, and those who are undergoing pre-service training under the Law on the Training Centers for Penal Institutions and Detention Houses will be determined.
