Neşet Güneş (26), who was sentenced to life imprisonment for killing Damla Dakım (25), whom he claimed to have cheated on him, with 47 knife wounds, was sentenced to 24 years in prison with a 'provocation' reduction in the retrial after the appellate court's annulment decision.
On September 14, 2023, Neşet Güneş, who had been serving an 8-year sentence for 'attempted murder' in an open prison, got into an argument with Damla Dakım, with whom he lived under a religious marriage, because she was talking on the phone with someone else.
As the argument escalated, Neşet Güneş attacked Damla Dakım with a knife he took from the kitchen, injuring her in the chest, neck, and back, and then fled. Neighbors called the police after hearing noises from the house. Police and medical teams were dispatched to the address upon the report. Despite the first intervention at the scene, Damla Dakım could not be saved after being taken to Konya City Hospital.
47 KNIFE WOUNDS ON HER BODY
In the autopsy of Damla Dakım, a total of 47 knife wounds were found on her neck, back, and chest. Additionally, it was determined that Damla Dakım had previously been subjected to violence and had gone to the Köprübaşı Police Station to file a complaint. Dakım's body was buried in Atabey Cemetery in the same neighborhood after the autopsy.
CLAIMED SHE CHEATED
The police, who initiated an investigation regarding the incident, caught Neşet Güneş in the house where he was hiding. After his procedures at the police station, Güneş was arrested by the court he was brought to at the courthouse. In his statements to the prosecutor's office and during the trial phases, Neşet Güneş claimed that Damla Dakım had cheated on him and stated that he committed the murder.
LIFE IMPRISONMENT SENTENCE GIVEN
A case was opened against Neşet Güneş at the Konya 3rd High Criminal Court for 'intentional murder' with a request for life imprisonment. In the hearing held on September 9, 2024, Güneş was sentenced to life imprisonment for 'intentional murder.' The court did not apply any reduction in the sentence.
After the decision, Neşet Güneş's lawyers appealed the ruling. The file was sent to the 1st Criminal Chamber of the Konya Regional Court of Justice for examination. The 1st Criminal Chamber, which reviewed the file, stated that the couple had mutual obligations of fidelity, and therefore, a minimum 'provocation' reduction should be applied to Neşet Güneş, annulling the given sentence and sending the file back to the local court.
RETRIED
In the retrial at the Konya 3rd High Criminal Court, the court sentenced Güneş to 24 years in prison for committing the 'intentional murder' under 'provocation.'
