It was noted that on the day of the incident, the defendants Enes Güran, Salim Güran, Yüksel Güran, and Nevzat Bahtiyar were found to be in and around Arif Güran's house at the time of the incident, as determined by the narrowed base analysis report and expert report. "Additionally, it was determined that there were real-live movements in the barn-house area at the time of the incident, supported by the report of the national criminal bureau dated 28/11/2024, and that Narin Güran also reached the barn-house area. In this context, it was concluded that the defendants were together in time and space until the end of the incident and did not demonstrate a will to prevent it, acting in unity of thought and action by failing to disclose the truth they knew, leading to the inability to definitively determine the motive for Narin Güran's murder, thereby demonstrating their intent to participate in the crime of intentional murder, and considering their attitudes after the crime, it was understood that they caused Narin Güran's death by strangulation and committed the crime attributed to them as joint perpetrators. According to the provisions of the law, the defendants Salim Güran and Nevzat Bahtiyar are to be separately sentenced to aggravated life imprisonment in accordance with Article 37/1 of the Turkish Penal Code, in relation to Article 82/1-e, 53/1, and 63 of the Turkish Penal Code. Considering the amount of the sentence they will receive, it has been decided to continue the detention of the defendants along with the judgment. Given the nature of the actions committed by the defendants, the manner in which the incident occurred, and their attitudes and behaviors during the post-incident and trial processes, it has been determined that there is no need to apply Article 62 of the Turkish Penal Code. It has been decided to keep the materials registered in the judicial custody as evidence in the file.
