"THE TRUSTEE PRACTICE IS AGAINST THE PRINCIPLES OF THE RULE OF LAW"

In the petition submitted to the court by the Mardin Bar Association on January 2, it was emphasized that the trustee practice is contrary to the principles of a democratic rule of law and local democracy, stating, "This intervention in the right to vote and be elected has turned into an unreasonable intervention against the requirements of a democratic society and has reached a level that increasingly increases its weight." The petition highlighted that the constitutional basis for the regulation added to Article 45 of the Municipal Law, which states that "the Minister of Interior may appoint a mayor in cases of removal from office due to crimes of aiding and abetting terrorism or terrorist organizations" was first added by Decree Law No. 674 and then by subsequent legal amendments.

"IT CONSTITUTES AN ILLEGAL INTERVENTION"

Additionally, the petition pointed out that "the fact that the authority to appoint is given to politically identified organs of the central government" opens the way for investigations and prosecutions that will be used as a justification for trustee appointments, stating, "For these reasons, since the possibility of removal from office is always present, a 'temporary' appointment turns into a 'permanent' appointment, constituting an illegal intervention."

"A REQUEST FOR INTERVENTION HAS BEEN MADE"

The petition recorded that the decision to remove from office and the discretionary power was used without considering the will of the voters; emphasizing the "Presumption of Innocence," it stated, "The manner and procedures of the trustee system violate the principles of the Constitution. The trustee system has eliminated local governance and integrated it with the central government. The trustee has been made permanent in Mardin. This situation is contrary to the Constitution. We request the acceptance of our request for intervention in the case opened by Ahmet Türk's lawyers, as well as the suspension and annulment of the trustee decision."
