Ebru Gündeş won the copyright lawsuit she filed against Avrupa Müzik and Bonus Müzik. The court determined that the two companies used 28 works belonging to Gündeş without permission in digital media, ruling that this use must be stopped and prohibiting its public communication.
The decision has been made in the copyright case filed by artist Ebru Gündeş against the European Music and Bonus Music companies. The Istanbul Intellectual Property and Industrial Rights Court ruled that the two music companies used 28 works belonging to Gündeş without permission on digital platforms, and decided to stop this action. Gündeş had filed a lawsuit two years ago, claiming that her works included in the albums "Şahane" and "10 Muhteşem Yıl Box Set CD8" were used without authorization. In the petition submitted by the artist's lawyer, Ergin Akçay, it was stated that the defendant companies had no rights over the mentioned albums, yet the works were used on digital platforms.
According to Hürriyet's news, the petition also emphasized that this situation violated the artist's financial and moral rights and caused irreparable damages. Gündeş had requested the prevention of unauthorized use of her works in the lawsuit and their removal from digital platforms. After a two-year trial, the court accepted Ebru Gündeş's requests. The ruling stated that European Music and Bonus Music unlawfully used 28 works belonging to Gündeş on digital platforms and that this action needed to be stopped. The court prohibited the use and public transmission of the mentioned works on the digital platforms of both companies. The decision once again highlighted the importance of oversight and sanctions regarding copyright in the digital music market and was considered a precedent in the music industry.
