The new regulation prepared by the Ministry of Environment, Urbanization, and Climate Change for apartment and site managements draws attention as a significant change that has been long awaited in the sector. With this regulation, a certification requirement is introduced for apartment and site management companies. The regulation also aims to improve the quality of apartment and site management services with a new draft regulation. In this context, detailed regulations will be made regarding the determination, classification, authorization, and registration of the qualifications of companies. Additionally, the education level and qualifications of personnel working in facility management companies will also be monitored. Sandalcı, who shared his views on the subject, stated that the certification requirement introduced by the Ministry would help solve many problems in the sector. "OUR CITIZENS WILL BE ABLE TO BETTER PROTECT THEIR RIGHTS BY ACCESSING RELIABLE AND TRANSPARENT MANAGEMENT SERVICES"Sandalcı emphasized that with the new regulation, facility management companies will be required to provide regular information to property owners by ensuring financial and administrative transparency. He pointed out that the transparent flow of information would increase trust in the facility management sector, and with this regulation, which will ensure services are provided by trained and qualified personnel, citizens will be able to access more reliable and transparent management services, thereby protecting their rights more effectively. He noted that this situation would reduce the problems faced by property owners and improve the quality of services in the sector, as classifications based on the size of the facilities would also contribute to providing higher quality services. "THE DEFICIENCIES IN THE 1965 LAW NEED TO BE ADDRESSED"Sandalcı stated that the 1965 Property Ownership Law does not meet the current needs of apartment and site management, expressing that this regulation is a long-awaited reform in the sector. He pointed out that the existing law does not meet modern needs and stated that this regulation will ensure that facility management services are restructured in accordance with today's demands. He indicated that in the future, with the modernization of the legislation, a more effective supervision and management approach will be implemented in apartment and site management. "THE 'MAFIA' UNDERSTANDING IN THE SECTOR WILL END"Sandalcı expressed that the 'mafia-style' management approaches and abuses encountered in some sites will come to an end with this regulation. He emphasized that high fees and uncontrolled managements will now be monitored, stating: "Some companies that have operated in the sector for years without licenses and oversight have victimized citizens. These companies often provided services with a non-transparent management approach. However, this regulation will put an end to exorbitant fee practices and unlawful management approaches that have victimized property owners. Thus, our citizens will be able to receive services from safer and accountable managements," he said. "WE WILL ENSURE MILLIONS OF PEOPLE HAVE ACCESS TO MORE TRANSPARENT AND RELIABLE MANAGEMENTS"Sandalcı also provided information about the efforts to establish permanent standards in the sector. He stated that they are planning a more comprehensive regulatory process in collaboration with the Ministry soon, announcing that they will hold a workshop involving academics, representatives of property owners, and facility management companies from across Turkey. In these meetings, how to establish permanent standards in the sector will be discussed. Sandalcı stated that as a result of these efforts, they will ensure that millions of people living in apartments and sites across Turkey will have access to more transparent and reliable managements. He also noted that in the future, companies that do not provide the necessary documents to the sector will face penalties, management companies will be subject to classifications such as 'Type A certificate', and only companies with higher authority certificates will serve larger sites. He emphasized that companies that do not comply with the rules set by the Ministry will be removed from the sector. Sandalcı said, "With these regulations, a permanent and reliable system will be established in the facility management sector in Turkey. With this system, important steps will be taken, such as requiring guarantees from banks and imposing penalties on companies that do not comply with the established standards. The grievances of property owners will be minimized in this way," he said. "PARTICIPATION IN GENERAL ASSEMBLY MEETINGS IS MANDATORY"Suat Sandalcı finally addressed the importance of participation in the upcoming general assembly meetings of apartments and sites. He suggested that property owners should participate more actively in these meetings, stating: "Next month, general assembly meetings will begin in sites across Turkey. However, one of the biggest problems in our country is that property owners do not attend these meetings. Yet, in these meetings where management decisions and fee regulations are determined, decisions taken by a majority of 50%+1 can lead to objections later. Property owners need to take responsibility and actively participate in these meetings. This way, they will also have a direct say in the decisions made and can contribute more consciously to the management processes," he said. NEW REGULATION FOR APARTMENT AND SITE MANAGEMENTS FROM THE MINISTRYThe General Directorate of Professional Services of the Ministry of Environment, Urbanization, and Climate Change is working on a comprehensive regulation for apartment and site managements in line with citizens' demands. With the upcoming regulation, updates will be made to the Law on Property Ownership No. 634, and a certification requirement will be introduced for companies providing apartment and site management services. These companies will be subject to Ministry oversight, and sanctions ranging from activity bans to penalties will be imposed on those that do not comply with the rules. DRAFT LEGISLATION IS BEING PREPAREDThe new draft regulation aims to improve the quality of apartment and site management services. Detailed regulations will be included regarding the determination, classification, authorization, and registration of the qualifications of companies. Additionally, the education level and qualifications of personnel working in facility management companies will also be monitored. It is aimed to ensure quality and reliability in facility management services through these sanctions, which can go as far as activity bans. The draft legislation has been submitted for the opinions of the relevant institutions and organizations.
