The verdict has been announced in the case concerning the killing of young footballer Kubilay Kaan Kundakçı in an armed attack. The court panel acquitted Aleyna Kalaycıoğlu, while sentencing Alaattin Kadayıfçıoğlu to life imprisonment for the crime of 'intentional killing.' At the hearing, mother Ülker Kundakçı, who said, “The instigator of my son is Aleyna,” and her family reacted to the acquittal decision in front of the courtroom after the verdict.

In Istanbul, a verdict hearing was held in the case with 10 defendants regarding the killing of footballer Kubilay Kaan Kundakçı in an armed attack. The court ruled for the acquittal of Aleyna Kalaycıoğlu and sentenced Alaattin Kadayıfçıoğlu to life imprisonment.

ALEYNA KALAYCIOĞLU ACQUITTED

At the verdict hearing held on October 16 at the Anatolian 27th High Criminal Court, singer Aleyna Kalaycıoğlu, who was tried in the indictment on charges of “incitement to intentional murder” and “failure to report a crime,” was acquitted.

ALAATTİN KADAYIFÇIOĞLU SENTENCED TO LIFE

Kalaycıoğlu, who was arrested after the incident, had been in prison for about 7 months. The court sentenced Alaattin Kadayıfçıoğlu, who was tried for “intentional murder,” to life imprisonment.

RECONCILIATION ATTEMPT ENDED IN BLOOD

The incident occurred on the night of March 19 on Sıddık Street in Ümraniye. According to the allegation, rapper Vahap Canbay, a member of the Canbay & Wolker group, wanted to reconcile with his ex-girlfriend Aleyna Kalaycıoğlu, from whom he had separated about 20 days earlier on a television competition. Canbay asked his friend, footballer Kubilay Kaan Kundakçı, for help with this. An argument broke out in a parked vehicle between the group that went to the music studio where Kalaycıoğlu was and the other side.

GOT OUT OF THE VEHICLE AND OPENED FIRE

After the argument, a person who got out of one of 2 vehicles that arrived in the area opened fire on the vehicle carrying Canbay and his friends. Kundakçı, who was seriously wounded, could not be saved despite the interventions performed at the hospital where he was taken. After the incident, 7 people, including Kalaycıoğlu and Kadayıfçıoğlu, were arrested. The Istanbul Anatolian Chief Public Prosecutor’s Office prepared an indictment against 10 defendants.

POSSIBILITY OF A “PLANNED ATTACK” IN THE INDICTMENT

In the indictment, according to the security camera footage in the expert examination, it was alleged that Alaattin Kadayıfçıoğlu got out of one of 2 vehicles that pulled up next to the victim’s vehicle and fired one shot. According to the footage, Kadayıfçıoğlu got out of the vehicle at 22:57:41, and about 3 seconds later a gunshot was heard. In the indictment, which drew attention to the fact that there were phone calls among the defendants before and after the incident, it was assessed that the attack might have been planned rather than spontaneous. In the indictment, life imprisonment was also sought for Aleyna Kalaycıoğlu and Zuhal Kalaycıoğlu, who were alleged to have incited him to murder along with Kadayıfçıoğlu.

PROSECUTOR HAD REQUESTED HER RELEASE

In his opinion on the merits announced on October 6, the prosecutor stated that there was no conclusive evidence that Aleyna Kalaycıoğlu committed the crime of “incitement to intentional murder.” The prosecutor stated that there was no clear instruction aimed at intent to kill in the phone calls and communication traffic. In the opinion, it was requested that Kalaycıoğlu be sentenced to up to 1 year in prison for the crime of “failure to report a crime” and released under judicial control conditions. For Kadayıfçıoğlu, life imprisonment was sought for “intentional murder” and between 2 and 4 years in prison for violating Law No. 6136 on Firearms, Knives and Other Tools. Acquittal was requested for Zuhal Kalaycıoğlu, Bilal Kadayıfçıoğlu and İzzet Yıldızhan. The release of detained defendants Hüseyin Can Avcı, Mustafa Rece, Metin Kadayıfçıoğlu and Engin Taşkıran was requested under judicial control conditions.

“MY ONLY CONCERN WAS TO GET MY DOG”

Making her defense at the previous hearing, Aleyna Kalaycıoğlu said that she had been in prison for about 7 months, that she was accused of losing someone she loved, and that she could not have foreseen what happened. Kalaycıoğlu stated that on the day of the incident her only concern was to get her dog. Alaattin Kadayıfçıoğlu, on the other hand, claimed that he drew the gun to deter the other side and that he had no intent to kill.

HIS MOTHER DID NOT REQUEST RELEASE

Kundakçı’s mother, Ülker Kundakçı, had also requested at the previous hearing that the defendants not be released and said that she had filed a criminal complaint against Bilal Kadayıfçıoğlu.
