The expert report regarding the death of Zeynep Naz Sarıkaya, who was struck by a truck driven by Efe Şayık, has emerged. The report states that the speed limit at the intersection was 30 kilometers per hour, while Şayık's speed was determined to be 82.8 kilometers per hour. On the other hand, Naz Sarıkaya's mother, Ümmü Gülsüm Sarıkaya, reacted to the decision for release, saying, "Efe came to FSM Boulevard with his 2.5-ton weapon and caused death."
The expert report regarding the accident that caused the death of Zeynep Naz Sarıkaya (16), who was hit by unlicensed driver Efe Şayık (19) with a pickup truck in Bursa, has emerged. In the Forensic Traffic Expert Report, which states that the speed limit at the intersection is 30 kilometers, Şayık's speed was determined to be 82.8 kilometers.
The accident occurred on October 9, 2024, around 11:00 PM on Fatih Sultan Mehmet Boulevard in the Nilüfer district. Zeynep Naz Sarıkaya, who was on her way home after watching the TOFAŞ-Keravnos basketball match, attempted to cross the street. At that moment, the pickup truck with license plate 16 SYK 19, driven by Efe Şayık, hit Sarıkaya, a 12th-grade student at Şehit Onbaşı Hakan Yutkun Anadolu High School. Sarıkaya, who was injured, was taken to a private hospital by ambulance.
'HE RAN AWAY FIRST, THEN SURRENDERED' After the accident, driver Efe Şayık fled but later went to the police and surrendered. It was determined that he was unlicensed, and he was released by the magistrate court under judicial control conditions. After an appeal against this decision, Şayık was arrested by the Magistrate Criminal Court, charged with 'causing injury with conscious negligence that could lead to life-threatening situations.'
Zeynep Naz Sarıkaya passed away on October 19, ten days after the accident, in the hospital where she was being treated.
HE WAS RELEASED WITH HOUSE ARREST AT THE FIRST HEARING After the prosecutor's investigation, a case was opened against Efe Şayık for 'causing death with conscious negligence,' with a request for up to 15 years in prison. He appeared before the Bursa 52nd Criminal Court of First Instance for the first time on December 6, stating in his defense that he had a green light and that Zeynep Naz suddenly jumped onto the road at the pedestrian crossing. He said, "Although the deceased cannot come back, I want it to be known that I did not do this intentionally or willingly," and he was released under the condition of not leaving his residence.
'THE DRIVER DID NOT SLOW DOWN, THERE WAS NO OBSTRUCTIVE ELEMENT TO VISION' Meanwhile, the expert report regarding the accident has emerged. In the Forensic Traffic Expert Report, which states that the speed limit in the area is 30 kilometers, Şayık's speed was determined to be 82.8 kilometers. The report noted that the speed limit on the road where the accident occurred was 50 kilometers, and at the intersection where the accident took place, it was 30 kilometers. It was stated that Şayık's claim in his statement to the prosecutor that he did not notice the pedestrian due to a vehicle turning left at the intersection was also not true, and it was noted that "Upon examination of the scene, there was no obstructive element affecting visibility, and there was no road defect on the asphalt surface. The distance covered during the vehicle's deceleration phase was measured to be an average of 23 meters, and when this data was matched with the camera footage, it was calculated that the average speed of the vehicle upon entering the traffic lights was 82.8 km/h."
'I DID NOT HEAR ANY BRAKE NOISE' The report indicated that Zeynep Naz was at fault for trying to cross the street while the pedestrian light was red, while Efe Şayık was considered to have a major fault. The report also included the statement of R. E. E. (17), who turned back after noticing the vehicle while trying to cross the street. R. E. E. stated in his testimony on the day of the inspection that the vehicle was going too fast and that he did not hear any brake noise, saying, "I do not remember whether the vehicle that hit me applied the brakes or not, but I did not hear any brake noise. After stepping onto the road, I did not have the opportunity to look back at the light. I stepped back when I saw the vehicle coming. I think the vehicle was going over 50 kilometers. If it had hit me at 50 kilometers, it would have lifted me up and dragged me. However, at the moment of the accident, Zeynep Naz was almost on top of the car. In my opinion, the speed of the vehicle at the time of the accident was around 70-80 kilometers," he said.
'HE SPREAD DEATH WITH HIS 2.5-TON WEAPON' Ümmü Gülsüm Sarıkaya (42), the mother of Zeynep Naz Sarıkaya, who stated that the report revealed the faults in the accident, reacted to the release of the driver at the first hearing, saying, "My daughter was murdered by Efe Şayık when she was 16 years old. Efe came to FSM Boulevard with his 2.5-ton weapon and spread death. The bullet hit my daughter. He had no license and did not obey speed limits. If he was not going to slow down at that pedestrian crossing, why was the pedestrian crossing made? Why were those lines drawn? My daughter was deceived by a light that she thought was green for her. We are talking about a 16-year-old child. Here, with the stopping of two vehicles, my child thinks the light is green for her. I want Efe Şayık to be tried as a murderer in the heavy penal court. The lawyer of the Ministry of Family also stated in court that this was a possible intent. This also requires him to be tried in heavy penal court. I call out to our President. Please respond to my voice. I have been burning for 6.5 months; I do not want other mothers to burn. She was murdered by an unlicensed driver. We need to impose very strict penalties so that these drivers do not take other lives," she said.
'HE DID NOT PRESS THE BRAKE OR HORN DESPITE SEEING' Father Yetkin Sarıkaya (46) stated that Efe Şayık's statements in the police, inspection, and prosecutor's office did not match, saying:
"The speed limit on the road is 30 kilometers as you approach the traffic lights. Nevertheless, it is clear that Efe Şayık was speeding. The expert report shows that Efe Şayık's speed was 82 kilometers.
The biggest factor here, the main reason, the most frightening event is Efe Şayık's continuation on his way despite seeing Zeynep Naz and her friend, essentially with the mindset of 'whatever happens, happens,' and realizing that he has killed my child. The painful point here is that we did not realize this at first. The common point of these three statements is that he saw my daughter and her friends the moment she entered the pedestrian crossing. Despite seeing them, he did not hit the brakes or honk the horn. When we look at it, this incident should be tried in a heavy penal court, not in a misdemeanor court. Human life should not be taken so lightly. Efe Şayık acted with the mentality of 'I will hit whoever comes in front of me' because he saw a green light. In this way, he has killed my child.
