The search for a "European model" in the internal regulations has gained momentum in order to improve the quality of legislation in the Grand National Assembly and to reduce the tension in the General Assembly. The report of the French Parliament distributed to the members of parliament highlighted a four-tier disciplinary system ranging from "light to heavy" and sanctions including salary deductions.
In the Grand National Assembly of Turkey, a new approach to the internal regulations is being discussed to enhance the quality of the law-making process and to prevent the frequent tensions experienced in the General Assembly. It has been stated that the "Report on Legislative, Oversight, and Budget Processes in the French Parliament," prepared by the Directorate of Parliamentary Research Services, has been distributed to the members of parliament, and the recommendations in the report bring forth stricter sanctions under the discipline heading.
FOUR-LEVEL "FRENCH STYLE" DISCIPLINE ON THE AGENDA
Within the framework of the draft, it is proposed that the attitudes and behaviors in the General Assembly hall be punished by "grading." Accordingly, there is a "warning" at the lowest level, which is a verbal warning, while a structure is planned where the sanctions become increasingly severe. It is anticipated that there will be a deduction from the salary at the warning stage recorded in the minutes, and an even greater deduction at the reprimand stage. As the heaviest measure, in the option of temporary suspension, it is stated that sanctions such as the member of parliament being unable to participate in the Assembly's activities for a certain period, restrictions on entering the building, and salary deductions of up to two months are being considered. It is evaluated that the regulation aims to increase deterrence, especially in cases of insults, threats, or physical intervention at the podium.
LAWS WILL "COOK IN THE COMMISSION" MODEL
According to a report by Türkiye Newspaper, the search for changes in the internal regulations is not solely focused on discipline. In order to reduce criticisms that "laws come to the General Assembly without sufficient discussion" in the current system, the "Commission-Focused Model" is also being considered. In this approach, it is aimed to clarify the main framework and technical details of the laws in the commissions, to make commission reports more decisive in the legislative process, and to transform the General Assembly into a ground where more political negotiations are conducted instead of technical discussions.
REMINDER OF THE 2018 CANCELLATION BY THE CONSTITUTIONAL COURT
A similar discussion had also come to the agenda in 2018, where the provisions of the internal regulations foreseeing salary deductions for members of parliament faced the cancellation decision of the Constitutional Court. In the new study, it is aimed to strengthen the legal basis of possible sanctions and to create a more solid framework by taking into account the approach of the Constitutional Court.
