The long-standing administrative affiliation dispute in the villages of Günyüzü and Üçtaş, located in the Kürtün district of Gümüşhane, has been resolved with a definitive ruling from the Council of State. Approval has been granted for the two villages to be connected to the Doğankent district of Giresun.

The administrative affiliation debate that has been ongoing for 35 years in the villages of Günyüzü and Üçtaş, which are connected to the Kürtün district of Gümüşhane and wish to be affiliated with the Doğankent district of Giresun, has been resolved with a definitive ruling from the Council of State.

TWO VILLAGES WENT TO REFERENDUM IN 2018

Mustafa Temel, who served as the village head during the process of taking their villages to a referendum for administrative affiliation, stated, "In the referendum initiated by the Elder Council of our Günyüzü village in 2018, 272 voters voted 'yes' and 196 voted 'no'. Similarly, in Üçtaş village, out of 677 people, 474 voted 'yes' and 33 voted 'no'."

GOVERNORSHIP AND MINISTRY REJECTED

However, the Gümüşhane Governorship and the Provincial General Assembly responded negatively to the request, citing that a majority could not be achieved. The Giresun side, on the other hand, expressed a positive opinion and supported the advancement of the process. The Ministry of Interior rejected the request on the grounds that the necessary majority was not achieved in the public vote.

LAWSUIT BROUGHT TO THE COUNCIL OF STATE

Subsequently, in the lawsuit filed by the legal entity of Günyüzü village, the 10th Chamber of the Council of State issued a cancellation decision. Upon appeal, the file was brought to the Administrative Litigation Chambers of the Council of State. The board emphasized the principle of local governance and stated that the demands of the public should be taken into account. The board highlighted that the Ministry of Interior made its decision solely based on the opinion of the Gümüşhane Governorship and that a detailed examination regarding geographical, economic, and public services was not conducted after the public vote.

For this reason, it was ruled that the process was not in the public interest. The final decision was made with a majority vote, and the villages of Günyüzü and Üçtaş were connected to the Doğankent district of Giresun. With the decision of the Council of State to connect the villages of Günyüzü and Üçtaş to Giresun, the number of villages in the Doğankent district increased to 11, while the number of villages in Giresun rose to 550. The number of villages in Gümüşhane decreased to 314.
