A new system has been implemented to strengthen security, transparency, and uniform application in transactions conducted with power of attorney in land registry. With the new application called 'Power of Attorney Inquiry' transferred to the e-Government system by the Union of Turkish Notaries, powers of attorney issued by notaries or consulates can now be viewed on e-Government. With this application, the revocation processes of powers of attorney, especially those that will be used for transactions at land registry offices, can also be carried out through 'WebTapu'.

Mustafa Hakan Özelmacıklı, Chairman of the Board of Altın Emlak Global, stated, "Transactions by power of attorney are one of the most common types of transactions in the real estate sector. Therefore, being able to track the power of attorney through e-Government and the instant visibility of revocation processes in all land registry offices is a very important step that protects both property owners and transaction parties. The automatic registration of revocations made through WebTapu or in person at the land registry office into the registry will significantly prevent attempts at fraud and loss of rights," he said.

'PHYSICAL OR EMAIL SENT REVOCATION REQUESTS ARE NO LONGER VALID'

Özelmacıklı stated that revocation requests sent via fax, email, or mail are not accepted in order to ensure secure identity verification, saying, "Citizens can access the power of attorney transaction information they have provided at notaries and consulates through the 'Person Power of Attorney Inquiry' service offered via the e-Government portal, and can perform the revocation process by transitioning to the WebTapu system from this channel. For powers of attorney before January 1, 2023, both physical revocation records and electronic records will be checked. After this date, transactions will only be carried out through electronic verification," he added.

"TURKEY'S REVOCATION SYSTEM IS OPERATIONAL"

Özelmacıklı stated, "Revocation means that the person granting the power of attorney unilaterally terminates the authority previously granted to the attorney. In other words, a person can revoke the authority given to the attorney to act on their behalf without having to provide any reason and without needing the consent of the other party. The revocation process is a 'destructive innovation right' that terminates the power of attorney relationship going forward. Although it is sufficient for the attorney to be informed of the revocation for its validity, in practice, there is an obligation to ensure that the attorney is still able to act as if they are authorized with third parties. Revocation cannot be asserted against third parties who act in good faith and are unaware that the attorney has been revoked. Therefore, especially in real estate transactions, it is not sufficient to only inform the attorney of the revocation; the situation must be communicated to the land registry offices and recorded in the revocation registry. This way, the termination of the attorney's authority becomes visible to all land registry units, ensuring transaction security and preventing potential loss of rights. In order to ensure uniformity in the revocation registry, the Turkey Revocation System has been implemented, and with this system, revocations recorded in the revocation registry from WebTapu or any land registry office can be viewed and queried by all land registry offices," he concluded.
