HE FIRST SET THE DOOR ON FIRE WITH THINNER
Serhan Kaynar, who lives on the 4th floor of the apartment in Varlık Neighborhood, allegedly set fire to the door of his upstairs neighbor Tezcan K., whom he had previously threatened by saying, 'Look, I will throw a Molotov cocktail at your house, I will burn it,' by pouring thinner on it on October 7, 2024. After fleeing to his apartment with the intervention of neighbors, Kaynar was detained by the police. After his procedures, Serhan Kaynar was arrested at the courthouse to which he was referred.
THEN HE INJURED HER WITH THE ELECTRIC DEVICE
Two months after the incident, Serhan Kaynar, who was released, set up an electric device with nails and wires on a 2-meter-long board and waited for his neighbor Tezcan K. at her home on December 27, 2024. Tezcan K., who arrived around 10:00 PM, was attacked by Kaynar, who opened the door. Tezcan K. was injured when the nailed part of the device made contact with her chest, causing her to be electrocuted. While neighbors heard her screams and came to help, Serhan Kaynar was detained by the police.
HE WAS ARRESTED FOR 'ATTEMPTING TO KILL WITH PREMEDITATION'
In his first statement, Kaynar admitted his crime, stating that after setting his neighbor's door on fire with thinner, he decided to kill her. He mentioned that he prepared the device with the wires he collected because he had no money, and he thought that the woman would die when the nails hit her. He expressed that he hit her chest with the board when she entered the building. Serhan Kaynar was arrested for the crime of 'attempting to kill with premeditation.' Two separate cases were opened against Kaynar for both starting a fire in the apartment and attempting to kill his neighbor. No punishment was given to Serhan Kaynar regarding the incident of setting Tezcan K.'s door on fire due to a report indicating he had bipolar disorder.
IT WAS DETERMINED THAT THE DEVICE WAS LETHAL
In the case opened at the 4th Heavy Criminal Court, an electrical engineer who examined the electric device prepared by Kaynar, who was tried for 'attempting to kill with premeditation against a woman,' noted that it did not have a lethal effect. However, the court requested a re-examination of the device and a report to be prepared. In the final examination, it was stated that the device was prepared in a dangerous manner and could lead to death.
A DECISION HEARING WAS HELD
The trial of the detained defendant Kaynar continued. The complainant Tezcan K., stating that she did not feel safe, said, "The crime is proven by the evidence. I request that he be punished for the crime of 'attempting to kill with premeditation against a woman.'" In his defense, Kaynar stated that his intention was to scare her, saying, "I was tried to be portrayed as a hunter. I am not an assailant. I said the same in the first hearing. The nails were rusty, so they were not lethal. Many people can be electrocuted but do not die. I request my release and acquittal."
HE WAS SENTENCED TO 13 YEARS
The court panel ruled that the defendant had committed an act that required an aggravated life sentence, that the act remained at the attempt stage, and that there were only minor injuries on the victim's body that could be remedied with simple intervention, thus sentencing him to 13 years in prison.
