On Monday, October 5, at 19:45, a suspicious death occurred in Yenilehir Neighborhood, Beyoğlu district of Istanbul. According to the information obtained, Hasan Beyazyıldız (37) entered his brother's house with a spare key after not hearing from him for a while. The elder brother Beyazyıldız found his brother Hüseyin Beyazyıldız (30) motionless on the sofa in the living room. Upon the report, health teams arriving at the scene determined that Hüseyin Beyazyıldız had died.

FOUND SHOT IN THE HEART

In the initial examinations by police teams at the scene, it was determined that Hüseyin Beyazyıldız was shot in the heart. It was learned that there were no residues under Beyazyıldız's fingernails, and no signs of assault or sharp object injuries were found on his body. It was also determined that there were no signs of forced entry on the doors and windows of the house.

During the work of the crime scene investigation teams, an unlicensed pistol and its cartridges were found next to the sofa, while a spent casing was found under the sofa and cartridges were found in an ashtray. It was learned from police investigations into the incident that Hüseyin Beyazyıldız had a total of 11 criminal records, primarily for 'Drug use' and 'Violation of the Firearms Law.' It was also learned that his brother Hasan Beyazyıldız stated that he came home when he could not reach his brother, opened the door with his own spare key, found his brother motionless, that his brother had no enemies, and that he was released from prison 6-7 months ago.

It was learned that Hüseyin Beyazyıldız, who was found dead, had appointed his brother as a guardian through his Apple account on April 9. After the public prosecutor's inspections and the work of the crime scene investigation teams, Beyazyıldız's body was taken to the Forensic Medicine Institute Morgue to determine the exact cause of death. The prosecutor's office launched an investigation into the death, which is considered suspicious.

Demircan said, "After Apple defines the digital legacy contact, Apple gives this person an ID, a number, and this number is requested to be stored unchangeably by that person. Later, if a death occurs, for access to that data to be provided, the legacy contact must report that number and the death certificate to Apple to prove they are the legacy contact. After this reporting process, the legacy contact can access all kinds of digital assets of the deceased person on Apple. Particularly, almost all data stored on iCloud is accessible. This includes files, notes, and photos. If stored on iCloud, emails, keychain, and all passwords stored within it are fully accessible to this person, and in case of any problem, they can intervene quickly. After a death occurs, the digital legacy contact must apply to Apple via the application. After this application process, the inheritance process, i.e., the transfer process, occurs, and they can access the digital legacy of that person. When you define someone as a guardian, they cannot access this data while you are alive. The person you define as an heir must report both the special number assigned to them and the death certificate to Apple, and then access is provided through the access data coming from Apple. When you define someone, it does not directly mean they can access."

Demircan said, "Legally, serious problems have been experienced in the past regarding this digital legacy. The fact that critical information for the family of the deceased is stored in that cloud, their need to access that information, but the inability to access that data due to lengthy court and other processes, and in most cases phone manufacturers not allowing access to this data, led to serious problems. Today, many phone companies support defining a digital legacy contact, and after this definition process, all data of the deceased person can be accessed remotely. While the defined digital legacy contact can directly access all data of the deceased person, they also have the authority to give instructions for the permanent deletion of all data of the deceased person without obtaining approval from anywhere else."
