POWERS OF BANKS AND FINANCIAL INSTITUTIONS ARE BEING EXPANDED



According to a statement from the Ministry of Justice, strict supervision is being introduced for bank transactions and telephone subscriptions with the 4th Judicial Reform Strategy Document, which consists of 5 objectives, 45 targets, and 264 activities announced on January 22. Within the scope of the third objective of the Judicial Reform Strategy Document, "Increasing the Effectiveness of the Criminal Justice System," necessary regulations will be made regarding banks, financial institutions, and telephone subscriptions. The regulation aims to expand the scope of duties and powers of banks and financial institutions, increasing their responsibilities, and to enable more effective combat against cyber crimes with new obligations for banks, financial institutions, and mobile operators. Regulations will be implemented to address issues arising from confiscation and seizure in criminal proceedings, especially regarding fraud and theft crimes committed using banking and information systems.

According to the ministry's statement, if the information or document requested by the public prosecutor, judge, or court within the scope of an ongoing investigation or prosecution is not sent within 10 days, administrative fines will be imposed on banks and financial institutions related to the judicial process.



In crimes committed using information systems, the relevant account will be suspended for a certain period. The benefits subject to the crime in the suspended account can be seized without the requirement of a report as specified in Article 128 of the Criminal Procedure Code. If it is understood that the seized benefits subject to the crime belong to the victim who suffered from the crime, they will be returned to the owner.



Additionally, under the new regulations, accounts cannot be opened in banks and electronic payment institutions without verifying chip ID documents. Individuals whose facial images are not suitable for identification will not be able to perform transactions from ATM devices. Under the amendment, ATM security camera recordings will be kept for at least two years.



"TELEPHONE SUBSCRIPTIONS WILL BE UPDATED"



According to the statement, with the new regulations to be made under the Judicial Reform Strategy Document, the establishment of telephone subscriptions will be strictly regulated through certain identity verification methods to prevent crimes. All telephone subscription records will be updated, and lines whose subscription records are not updated within a specified period will be closed to communication.



NUMBER OF LINES IS BEING LIMITED



Citizens will be allowed to have a maximum of three, while foreigners will be allowed to have a maximum of one mobile communication line. Telephone lines identified as being used in fraud crimes may be disconnected. If the information or document requested by the public prosecutor, judge, or court within the scope of an ongoing investigation or prosecution is not sent within 10 days, administrative fines may be imposed on operator companies by the public prosecutor.
