Ayşe Tufan, who was sexually assaulted by a supermarket employee who entered her home in Istanbul's Sisli district and won 643 thousand TL in compensation after a legal battle, experienced an enforcement shock. The employer company that made the payment had a lien placed on Tufan's salary by demanding back the portion of the compensation attributable to the attacker, who is in prison, from the victim woman. Stating that the attacker has no ability to pay, the victim woman filed a new lawsuit for 321 thousand TL against the employer.

Chemist Ayşe Tufan, who was subjected to sexual assault, battery, and theft by a market employee in her home in Istanbul's Şişli district 15 years ago, faced an unbelievable situation in her legal battle. The employer company, which paid the compensation that the court sentenced the company and the attacker to pay, demanded back via execution the portion of the money that fell to the attacker employee from the victim woman.

In the incident that took place in Şişli, Istanbul, market employee Nurettin Yıldız, who entered the home on the pretext of carrying shopping bags, attacked chemist Ayşe Tufan. As a result of the trial, Istanbul 19th Heavy Penal Court sentenced the defendant Nurettin Yıldız to 29 years and 2 months in prison for the crimes of "attempted sexual assault", "attempted murder", and "theft".

THE COMPANY THAT PAID THE COMPENSATION HAD THE VICTIM'S SALARY ATTACHED

In the compensation lawsuit filed after the criminal case, the court sentenced the attacker employee and the employer company Greens Alışveriş Hizmetleri to pay a total of 643 thousand liras in compensation. Following the decision, the employer company that paid the compensation demanded back from the victim Ayşe Tufan the share of the paid amount that fell to the attacker employee. An execution proceeding was initiated against Tufan, who rejected this demand from the company, and an attachment was placed on the victim woman's salary.

NEW LAWSUIT FROM THE VICTIM WOMAN AGAINST THE COMPANY

According to the news by Neslihan Keskin from Milliyet; Ayşe Tufan, who experienced a second shock with the attachment of her salary, continued her legal struggle by stating that the attacker has no ability to pay and that the employer is responsible for the entire damage. Tufan filed a new compensation lawsuit for 321 thousand 998 liras 72 kurus.

Evaluating the decision, Lawyer Gürsel Devrim İyim stated that the employer's attitude lacks legal basis and made the following assessment: "As a rule, it does not appear legally valid for the employer to claim that the compensation paid to the victim belongs to the attacker employee and to demand it from the victim. It is possible for the employer to seek recourse against the employee who carried out the attack due to the payment made to the victim. However, this does not mean that the victim owes the employer. The natural addressee of the employer's right of recourse is not the victim, but the employee who caused the damage. If, despite this, the employer has initiated execution proceedings against the victim and applied a salary attachment, the transaction is not automatically considered valid."
