A draft law containing strict regulations on cigarettes and tobacco products is being prepared in Turkey. With the regulation that the AK Party is preparing to submit to Parliament, it is planned to ban the sale of all tobacco products starting from 2040, significantly restrict the use of cigarettes in open areas, and impose millions of lira in fines on those who do not comply with the rules.

Turkey is preparing to enter a new era with the most comprehensive regulation of cigarettes and tobacco products in recent years. The 41-article draft law, to be presented to Parliament by the AK Party with the support of the Ministry of Health, was developed in line with the European Union vision with the goal of a "tobacco-free generation by 2040." The draft law includes radical measures regarding the use and sale of tobacco products.

SALE OF TOBACCO PRODUCTS TO BE BANNED FROM 2040

One of the most striking points is that from January 1, 2040, the sale of all tobacco products will be completely banned across Turkey. Accordingly, not only cigarettes but also all nicotine-containing products such as e-cigarettes and heated tobacco devices will be removed from the market.

AIM IS TO LIMIT TOBACCO CONSUMPTION

With the new regulation going beyond the current ban, the effects of tobacco consumption on social life are also being minimized. Smoking in open areas at restaurants, cafes, and patisseries will be largely restricted. Businesses will only allow smoking in a special section covering up to 10 percent of the area, and food and beverage service along with waiter service will be strictly prohibited in these areas.

Significant changes are also on the way for sales processes: the era of cash payments will end. Tobacco products can only be sold through electronic systems where identity and age verification can be conducted.

The production and distribution of all nicotine-containing products, including e-cigarettes and derivatives, will also be completely prohibited. Very severe penalties are envisaged for those who violate these rules.

HEAVY PENALTIES COMING

Among the planned sanctions, individuals or businesses that continue selling and producing tobacco in violation of the ban face fines ranging from 1 million TL to 5 million TL. This amount represents approximately a 100-fold increase compared to previous practices. If tobacco products are sold to children, a prison sentence of up to one year is foreseen.

Individuals using tobacco products in designated prohibited areas face an administrative fine of 5,000 TL. Businesses that do not comply with the rules will face fines starting at 50,000 TL in the first instance and gradual closure penalties in case of recurrence.

When the prepared bill comes to the parliamentary agenda, a significant change is expected in the access and consumption of tobacco products across the country. While these steps are taken to protect public health, whether the regulation will be implemented and its effects in practice will be closely monitored.
