The details of the 12-article 'Draft Law on Strengthening National Solidarity and Social Integration' submitted to the Presidency of the Turkish Grand National Assembly have been announced. In the regulation, which will come into effect in the event that the PKK/KCK terrorist organization ends its de facto existence and disarms, organization leaders have been completely excluded from its scope.
In the framework law proposal prepared within the scope of the "Terror-Free Turkey" process, the groups that will not be able to benefit from the regulation have been clearly identified. According to one of the most important articles of the regulation, executives of the PKK/KCK terrorist organization will not be able to benefit from any rights provided by this law.
In addition to the executives, the other situations to be excluded from the scope are listed as follows:
- Intentional homicide offenses committed within the scope of organization activities
- Investigations and prosecutions conducted for crimes requiring life imprisonment or aggravated life imprisonment committed before June 1, 2005
DEFERRAL PERIODS IN INVESTIGATIONS AND PROSECUTIONS
Except for the excluded executives and exceptional crimes, a gradual deferral system will be implemented for individuals covered by the law. The deferral conditions according to the prison sentence required by the crime will be as follows:
- Investigations and prosecutions for crimes requiring a prison sentence of 15 years or less will be deferred for 5 years.
- For crimes requiring a prison sentence of more than 15 years, life imprisonment, or aggravated life imprisonment, the deferral period will be applied as 10 years.
WHO WILL BENEFIT FROM THE REGULATION AND NOT RECEIVE A SENTENCE?
The law proposal includes important steps for individuals who are not organization executives and have not been involved in serious crimes. Those who fulfill the specified conditions will be able to benefit from the law. The individuals who will benefit from the regulation are detailed as follows:
- Those who have not committed any crime within organization activities
- Those who declare they have left the organization
- Those who are caught, express remorse, and provide information
- Among those who are members of and assist the organization, those who voluntarily surrender and provide information (these individuals will not receive a sentence)
