In the investigation into the death of 8-year-old Oğuzhan Moğol, who fell from the 6th floor in Istanbul's Bahçelievler, blood-chilling statements have emerged. The incident's witness, his 9-year-old sister, claimed that after her older brother asked for chips, her uncle got angry with him and, saying, "Shall I throw you?", threw him out the window. An aggravated life sentence was requested for the uncle, who denied the accusations.

On August 20, 2024, in Lavanta Street, Siyavuşpaşa Neighborhood, Bahçelievler, Oğuzhan Moğol fell from the 6th floor of a 7-story building and lost his life. The investigation into Oğuzhan's death has been completed. In the indictment prepared by the Bakırköy Chief Public Prosecutor's Office, it was stated that at the time Oğuzhan fell from the window, his sister G. H. M. (9), the children's maternal uncle Mustafa Uğur S., his wife İ. S., and his mother-in-law Ş. K. were also in the house. The indictment stated that the children Oğuzhan Moğol and G. H. M.'s mother İ. S. and father Ersin Moğol were divorced, and custody of their children was with their mother İ. S.

"SHALL I THROW YOU?" HE SAID

The indictment included the prosecution statement of Oğuzhan's younger sister G. H. M. In her statement, G. H. M. recounted that they went to their uncle's house in the afternoon, that after her brother entered the house he shouted "I want chips," and that her uncle Mustafa Uğur S. said "You can't shout at me." G. H. M., stating that after coming out of the bathroom she saw her uncle in the armchair in front of the window with Oğuzhan in his lap, said that the window was open. G. H. M. recounted that her uncle said to her brother "Shall I throw you?", that Oğuzhan cried, and that she shouted "What are you doing?" In the continuation of her statement, G. H. M. recounted that at that moment her brother only called her by her name, and then her uncle threw Oğuzhan down from the window.

'I TOLD MY AUNT "MY UNCLE THREW MY BROTHER FROM THE WINDOW"'

G. H. M. said that immediately after the incident, her aunt asked "Where is Oğuzhan?", and her uncle answered "He's sleeping." G. H. M., stating that upon this she told her uncle "Don't lie," also stated that she told her aunt "My uncle threw Oğuzhan down from the window," and that her aunt shouted loudly "What?"

'YOUR GRANDMOTHER, YOUR FATHER, AND YOU WILL BE RUINED'

G. H. M. also alleged that her mother, grandfather, and uncle Uğur S. threatened her at the house in Bağcılar, and told her, "Your grandmother, your father, and you will be ruined; the outcome will be very bad."

'I HEARD HIM SAY "MOTHER, SAVE ME, HE SLIPPED FROM MY HAND"'

The indictment included the statement of witness H. A. regarding what he saw at the hospital on the day of the incident. In his statement, H. A. said that around 19:00–19:30, while he was walking toward the hospital's emergency department, a tall man passed by him, and this person shouted, "Mother, save me, he slipped from my hand."

THE SISTER'S STATEMENT WAS INFLUENTIAL IN THE CONTINUATION OF THE INVESTIGATION

In the indictment, it was stated that in the report of the Homicide Bureau, it had been assessed that the incident did not occur as a result of Oğuzhan being pushed by another person, but that Oğuzhan's sister G. H. M. had testified that her older brother was released or thrown down from the window by his uncle Mustafa Uğur S. The indictment conveyed that there was no claim of "pushing" or "pushing and causing a fall from a height" in the incident, and that the investigation continued based on the assessment that if Oğuzhan fell by himself or was released/thrown from the window by another person, the falling positions could be the same or similar. The indictment also stated that within the scope of the investigation, searches were conducted at the addresses of Mustafa Uğur S., mother İ. S., Ş. K., and aunt İ. S., digital materials were seized, and the suspects were brought before the Chief Public Prosecutor's Office and their defenses regarding the incident were taken.

SHE STATED THAT THE CHILDREN SAW THEIR UNCLE AS A FATHER FIGURE

The indictment also included the prosecution statement of Oğuzhan's mother İ. S. İ. S. said that she was not at home during the incident and did not know how Oğuzhan fell. Stating that Mustafa Uğur S. was very interested in the children and that the children saw their uncle as a father figure, İ. S. recounted that on the day of the incident, while returning from work, she received the news that her son had fallen and went to the hospital. İ. S. alleged that at the hospital, noting that her daughter G. H. M. was in a police vehicle, her daughter told her, "Everyone and the police are blaming my uncle, but my uncle did nothing."

SHE SAID THAT THE CHILD FELL WHILE WALKING BY HOLDING ON TO THE WINDOW

In the continuation of her statement, İ. S. said that after the incident she spoke with G. H. M., and her daughter told her that Oğuzhan was happy while playing a card game, jumped, then climbed onto the sofa, and while walking by holding on to the window, his foot slipped and he fell. Mother İ. S. also stated that G. H. M. said that Oğuzhan sometimes fell face down, sometimes on his back, and sometimes he jumped himself. İ. S., who also recounted that during the custody process G. H. M. wanted to go to her father and later gave up this decision, stated that she thought her daughter made a statement that her uncle threw Oğuzhan because she was threatened.

"I MOVED TO CATCH HIM BUT COULDN'T REACH HIM"

The indictment also included the prosecution statement of suspect Mustafa Uğur S. It was learned that in his statement, the suspect said that Oğuzhan grew up in his care, was very attached to him, and that they had a good relationship. The suspect, stating that on the day of the incident he took the children from their grandmother's side and brought them to his house, recounted that they played games at home, and later he sat on the sofa in front of the window and occupied himself with his phone. In his statement, the suspect, who said he saw Oğuzhan walking upright near the window, said, "He passed by holding on to the window. When I lifted my head from my phone, I saw Oğuzhan falling backwards from the window close to me. I made a move to catch him, but I couldn't touch him, couldn't reach him." The suspect uncle, recounting that after the incident he went downstairs and called an ambulance, stated that due to the shock he experienced he wanted to harm himself, and told the police, "Mother, I couldn't save him, I reached out my hand, I couldn't save him." It was conveyed that suspect Mustafa Uğur S., claiming that the statements of his niece G. H. M. accusing him were directed by her father, did not accept the accusation, saying, "I absolutely did not throw my nephew Oğuzhan down from the window or drop him from my hands."

MESSAGES BETWEEN THE MOTHER AND THE UNCLE WERE EXAMINED

The indictment also included the examination conducted on the mobile phone of suspect mother İ. S. In the examination, it was stated that no photographs or camera recordings related to the incident were found on the phone, and that the messaging was mostly related to family, work, and friends.

It was stated that İ. S. described her longing for her deceased son Oğuzhan through messages she sent to her own phone number. It was reported that İ. S. expressed in these messages that she constantly cried, missed her son very much, and wrote to herself because there was no one who would understand her.

In the indictment, it was reported that İ. S.'s distrust of her daughter G. H. M.'s accounts regarding the incident was also reflected in the correspondences. It was stated that İ. S. wrote that she thought G. H. M. was lying, did not know why she behaved that way, and told different things every day. It was recorded that the longing for Oğuzhan was also expressed in the correspondences between mother İ. S. and maternal uncle Mustafa Uğur S. It was reported that the suspect said he was not very close to G. H. M. and spent more time with Oğuzhan; while İ. S. stated that she did not trust G. H. M. and had come to expect everything from her daughter.

AGGRAVATED LIFE IMPRISONMENT REQUESTED FOR 'INTENTIONAL KILLING OF A CHILD'

In the indictment, it was stated that in the Forensic Medicine Institute report, the traumas that caused the child's death could have occurred as a result of a fall from a height, but it could not be distinguished whether he fell after losing his balance or due to another person's intervention. The prosecutor's office, however, by evaluating together G. H. M.'s accounts, the statement of witness H. A., camera footage, crime scene investigation reports, the autopsy report, and other evidence, concluded that there was sufficient suspicion to justify filing a public case to the effect that Mustafa Uğur S. killed Oğuzhan by throwing him down from an open window. In the indictment, it was requested that suspect Mustafa Uğur S. be sentenced to aggravated life imprisonment for the crime of 'intentionally killing a child'. As for mother İ. S., Ş. K., and sister-in-law İ. S., it was decided that there was no grounds for prosecution in investigations conducted regarding various crimes. The prepared indictment was sent to the Bakırköy Heavy Penal Court for evaluation.

"WE WILL ALSO DEMAND THAT THOSE IN THE HOUSE BE TRIED"

Father Ersin Moğol, who made a statement after the preparation of the indictment, said, "In August 2024, we received the news of my son's death. After receiving the news of his death, we were told that 'my son fell from the couch,' but when we got our daughter months later, in our daughter's statement there is a statement that her uncle threw her older brother down from the window, and this is my daughter's statement taken by the prosecutor's office accompanied by pedagogues. Following this, I obtained custody of my daughter. After I obtained custody of my daughter, this time the family threatened my daughter, both her grandfather, her uncle, and my ex-wife, saying, 'If you tell how your older brother fell, we will kill you too like your older brother.' We also filed a criminal complaint with the prosecutor's office regarding this. After a long time, we were waiting for the indictment; today we received the news that the indictment has been prepared. We were very undecided whether to be happy or sad, but I and my lawyers think that there are also deficiencies in the indictment. It was proven that my ex-wife did not take care of custody and did not fulfill the obligations of custody, and there is already a death at hand. It states that she was not at home that day and that she did not take care of my son and daughter before that, and that there was no grounds for prosecution regarding my ex-wife; we will object to this. The uncle is to be tried with an aggravated life imprisonment sentence; this is very good news for us. We will demand that those in the house also had great negligence and that those in the house also be prosecuted. We will take the necessary steps and we want them to be tried and serve their sentences as soon as possible," he said.
