While the finding in the referral letter of former Minister Fatma Betül Sayan Kaya, who was arrested in the fund investigation, that "despite making her first stock market investment, she carried out a high volume of transactions and transferred shares knowing in advance of the liquidation decision" drew attention, Kaya was seen unable to hold back her tears upon learning of the arrest decision.

In the fund investigation, the determination in the court referral document of former Minister Fatma Betül Sayan Kaya, who was arrested, that “despite being a first-time stock market investor, she carried out high-value transactions and acted with prior knowledge of the liquidation decision” stood out as the most striking detail of the investigation.

Critical decisions were taken within the scope of the “fund investigation” conducted by the Istanbul Chief Public Prosecutor's Office Terrorism Financing and Money Laundering Crimes Investigation Bureau regarding transactions carried out in capital markets. Former Minister of Family and Social Policies Fatma Betül Sayan Kaya, who was called to give a statement again as a suspect, her husband İlyas Kaya, and former Capital Markets Board (CMB) Chairman İbrahim Ömer Gönül came to the courthouse and gave statements to the prosecutor's office.

UPON HEARING THE ARREST DECISION...

Fatma Betül Sayan Kaya, whose statement proceedings at the courthouse lasted 2 hours and 15 minutes, was referred to the duty magistrate judge on charges of “opposing the Capital Markets Law” and “membership in an organization established for the purpose of committing a crime.” Fatma Betül Sayan Kaya, who was arrested by the duty magistrate judge and sent to Silivri Prison, was seen crying unable to hold back her tears when she learned that she had been referred to the court with a request for arrest.

SHE HAD NEVER ENTERED THE STOCK MARKET, BUT...

The technical and legal details in the prosecutor's referral-for-arrest document revealed the organized flow of information in the investigation. The most striking lines of the referral document included the following statements: “It is seen that the sale transaction here took place 1 day before the liquidation (…) considering that, despite being a first-time stock market investor, the investment amount was high, the suspect (…) carried out transactions knowing that the liquidation decision would be made.”

THE MOST CONCRETE EVIDENCE

Legal circles and experts following the matter considered this determination highlighted in the referral document as the most concrete evidence that a person making a stock market investment for the first time in her life acted with prior knowledge of share movements and critical decisions.

JUDICIAL CONTROL MEASURES IMPOSED ON HER HUSBAND

Her husband İlyas Kaya, who gave a statement within the scope of the investigation, and former CMB Chairman İbrahim Ömer Gönül were ordered to be released after judicial control measures, including signing at a police station and a ban on leaving the country, were imposed on them.

SHARE SALE WORTH 2 BILLION LIRA

In the investigation file, the high-value transactions carried out by the Kaya couple in the shares of Özata Denizcilik San. ve Tic. A.Ş. (OZATD) had come to the fore. Examinations determined that the Kaya couple purchased approximately 163 million lira worth of shares and sold those shares a few months later for approximately 2 billion 170 million lira.

THEY RETURNED WHAT THEY EARNED, BUT...

It was reported that the couple deposited approximately 1 billion 860 million lira of the profit they obtained into the voluntary restitution account within the Savings Deposit Insurance Fund (TMSF). After the allegations regarding the stock market transactions were reflected to the public, Fatma Betül Sayan Kaya resigned from her position as Deputy Chairperson of the AK Party.
