In Kocaeli, the uncle who killed his 2 nephews after an argument and wounded 1 person appeared before a judge for the first time. The defendant, who said that his deceased nephew Gazi was aggressive, stated: 'My older brother warned me, saying, "My children have blood in their eyes, they have become executioners, I cannot stop them." On the day of the incident, I fired only at Gazi in order to protect myself.' It was learned that the defendant has only one kidney and has been living with the kidney he received from the father of the deceased 10 years ago.
The incident occurred on July 10, 2025, in a single-storey house on Gazi Street, Fatih Sultan Mehmet Neighborhood, Kartepe district. According to the allegation, an argument within the family quickly escalated into a fight. In the incident, as a result of uncle Fesih Y. opening fire, his nephews Gazi Zafer Y. and Güven Y. and Makul S. were injured. While Makul S. went to the hospital by his own means, health and police teams were dispatched to the scene upon a report to the 112 Emergency Call Center. In the check carried out by the medical teams, it was determined that the siblings named Gazi Zafer Y. and Güven Y. had lost their lives. Regarding the incident, uncle Fesih Y., Dilaver Y. and K.Y. were taken into custody. After procedures completed at the Homicide Bureau of the Public Order Branch Directorate, among the suspects referred to the courthouse, K.Y. was released by the prosecutor's office, and Dilaver Y. was released by the court to which he was referred under judicial control conditions. Fesih Y. was arrested.
AGGRAVATED LIFE IMPRISONMENT SOUGHT TWICE
The trial opened against Fesih Y. on charges of intentional killing with premeditation twice and injury with possible intent began to be heard at Kocaeli 3rd Heavy Penal Court. The detained defendant Fesih Y. and the parties' lawyers attended the hearing. Saying he regretted it, defendant Fesih Y. said: 'I did not anticipate that the incident would come to this point. We are 8 brothers and do construction work. Gazi was a very nervous, aggressive person; he did not even listen to his father, and his other brother was the same. For this reason, my older brother Dilaver had also given him 3-4 million in money to help him, he had helped him start his business. About 1 year before the incident, Gazi and I argued at the construction site; he insulted me, held a knife to my throat. My older brother Dilaver intervened and sent me home. We talked with the deceased's father, my older brother Mustafa, and he asked me to drop the matter. Later we made peace; I did not hold a grudge against him.'
GAZI BOUGHT A GUN FROM ISTANBUL
Defendant Fesih Y., who said that his and Dilaver's houses were adjacent, said: 'Two days before the incident, my older brother Mustafa called me and asked me not to leave the house. He said, "Gazi bought a gun from Istanbul. Tell Dilaver too, do not let yourselves be killed, do not go outside." Gazi held a grudge against us because he thought that Dilaver and I were talking behind his back. Later I called my older brother Dilaver and told him what had happened. While I was sitting at home, our distant relative Maksut came. He said that my older brother Mustafa was upset and could not make his children listen to him. Later Mustafa's mother Cahide came. She also stated that she was concerned about the situation. Gazi was my flesh and blood.'
MY CHILDREN HAVE BLOOD IN THEIR EYES
Defendant Fesih Y., who said that he called his father from Ağrı for the division of property, said: 'On the day of the incident, Maksut called me by phone and said, "Do not come to the office, Gazi has come, he will not stay calm." In the evening I called my maternal uncle; when he said no one was there, I went to my office. I went to kiss my older brother Mustafa's hand. My older brother Mustafa said, "My children have blood in their eyes, they have become executioners, I cannot stop them." The next day, on the date the incident took place, my father came from Ağrı to resolve the matters. We all sat together in the garden of the house. Erol, Maksut, Dilaver, Mustafa, we were all there. My older brother Mustafa hugged my older brother Dilaver and said, "You prevented a major incident by not coming to the office, I cannot make my children listen to me." Later my 2 nephews who died also came. Gazi kept putting his hand to his waist. I told my maternal uncle about this. My uncle said to Gazi, "What do you want?" Gazi shouted at my uncle, and my uncle withdrew. I went inside and put my gun at my waist. Later Gazi said, "Get lost, damn it, I will blow this place up," and when he reached for his waist and pulled out the gun, I fired at him. There is no question of me shooting Güven and Makul. I did not receive any instruction from Dilaver and my father to kill them. I regret it very much; I wish I had died. I fired because I thought they would fire. I wish I had died and they had not died.'
The participating party's representative stated that the deceased had no weapons at all and that this was established by the crime scene report; in response to their lawyer's request for release, saying that defendant Fesih Y. was unwell, he replied that the defendant continued his life with the kidney of the deceased's father.
The court panel decided to hear the witnesses at the next session and to continue the defendant's detention, and adjourned the trial.
