In Hatay, at the private hospital where his wife gave birth, Hikmet Karaoğlan, who reacted to a fan being placed in the room after being told that the air conditioner was broken, got back the 46,400-lira birth fee through a Consumer Arbitration Committee decision. Karaoğlan, who also won the lawsuit the hospital subsequently filed against him, said, "Even if it is one lira, do not let anyone take away your rights."

Hikmet Karaoğlan, living in Hatay, won in the Consumer Court the legal battle he initiated by reacting to the placement of a fan in the room after the air conditioner in the room was faulty at the private hospital where his wife gave birth. Karaoğlan, who thanked the Ministry of Justice saying 'Justice has found its place once again,' said that he would show those who laughed at him during the process that he was right through the court decision.

IT WAS SAID THE AIR CONDITIONER WAS FAULTY AND A FAN WAS PROVIDED

Hikmet Karaoğlan's wife, living in Antakya district, gave birth at Private Mozaik Hospital on August 23, 2025. After the successful birth, the mother and child were placed in room number 1321 at Private Mozaik Hospital, and a fan was provided, saying that the air conditioner in the room where they would stay was faulty. After Karaoğlan's footage, in which he reacted to what happened and recorded those moments, the Social Security Institution and the Consumer Arbitration Committee launched an investigation. Following the investigations, Private Mozaik Hospital was found defective by the Consumer Arbitration Committee and it was decided to refund the 46,400 TL taken from the Karaoğlan family.

HOSPITAL FILED A COUNTER-LAWSUIT

After the decision, a counter-lawsuit was filed against Karaoğlan by Private Mozaik Hospital at the Hatay 2nd Consumer Court. Karaoğlan, who received a refund of the 46,400 TL birth fee a few months earlier, also won the legal battle he entered with Private Mozaik Hospital. The court, which decided to reject the lawsuit filed by the hospital, found in Karaoğlan's favor. Karaoğlan, stating that everyone should seek their rights, thanked the Ministry of Justice and the Consumer Arbitration Committee.

DO NOT LET ANYONE TAKE AWAY YOUR RIGHTS, EVEN IF IT IS ONE LIRA

Hikmet Karaoğlan, who won by seeking his rights in the fan case that became a laughingstock, said: "About a year ago, my wife gave birth at Private Mozaik Hospital. In the room where we stayed at the hospital, they had placed a fan for us in return for the money we paid. I reacted to this situation and applied to the Social Security Institution to seek my rights. In the end, by demonstrating that I was right, I requested a refund of the fee I paid and got my money back. Later, a lawsuit was filed against me by Private Mozaik Hospital. Thank God, I won the legal battle we waged together with my lawyer. The case concluded and the court decided to reject the lawsuit filed by the hospital. Thus, our being right in our legal battle was also proven. During this process, some friends made comments, some laughed at me, and some said I was talking nonsense. However, I sought my rights. I had received the refund of the money I paid about six months ago. About a week ago, I also won the court case. My advice to everyone is that in such situations, you should seek your rights to the end. Even if it is one lira, do not let anyone take away your rights. I thank our state, our Ministry of Justice, and the Consumer Arbitration Committee. Justice has found its place once again. My wish is that everyone seeks their rights and does not let their rights be taken away. My advice to Private Mozaik Hospital is also that they provide appropriate service in return for the fee charged. I do not find it right that a fan was placed in a hospital room during a period when the air temperature approached 50 degrees. Such a situation should not have happened. From what I heard, renovation and maintenance work was later carried out at the hospital. I think that thanks to the incident I experienced, a deficiency was noticed and remedied. I hope everyone seeks their rights in this way and similar grievances are not experienced again," he said.
