The crisis deepens after the 'absolute nullity' decision regarding the 38th Ordinary Congress held by the CHP in 2023. The 36th Civil Chamber of the Ankara Regional Court of Appeals rejected the CHP Headquarters' objection to the interim injunction. Following the decision, attention has turned back to the Kemal Kılıçdaroğlu and Özgür Özel camps.
ÖZGÜR ÖZEL'S TERM ENDS
The 36th Civil Chamber of the Ankara Regional Court of Appeals issued an 'absolute nullity' decision regarding the CHP's 38th Ordinary Congress, held on November 4-5, 2023. With the decision, CHP Chairman Özgür Özel and the current party leadership's duties ended, while former Chairman Kemal Kılıçdaroğlu returned to office.
BACK-TO-BACK OBJECTIONS FROM CHP
Following the decision, the CHP leadership filed objections with both the court and the Supreme Election Council. However, the 36th Civil Chamber of the Ankara Regional Court of Appeals rejected the CHP Headquarters' objection to the interim injunction. The court announced that the decision was reached unanimously after reviewing the file.
“THE DECISION IS FINAL”
In the court's reasoned assessment, it was stated, referencing the relevant articles of the Code of Civil Procedure, that there is no separate avenue for appeal against interim injunction decisions issued by appellate courts.
The decision included the following statements: 'Since it is understood that the interim injunction decision issued by our Chamber is final, it has been necessary to reject the defendant's attorney's objection to the interim injunction.'
It was also emphasized that the implementation of interim injunction decisions does not halt the objection process.
BARIŞ YARKADAŞ'S CLAIM ABOUT KILIÇDAROĞLU
Journalist Barış Yarkadaş, speaking on TV100, shared notable insider information about the process. Yarkadaş stated that after Özgür Özel's evaluation with his friends, an agreement was reached to send Önder Sav as an intermediary to Kemal Kılıçdaroğlu.
However, Yarkadaş, who claimed that Kılıçdaroğlu only wanted to meet with Özgür Özel, said: 'Kemal Bey refuses to meet with anyone other than Manisa Deputy Özgür Özel. Kemal Bey is now waiting for Özgür Özel.'
