For employees who became insured after September 8, 1999, the 3-article proposal referred to the Planning and Budget Committee of the Grand National Assembly of Turkey envisages granting gradual retirement rights to citizens who have completed their premium days without requiring an age condition.

On September 8, 1999, a historic bill was submitted to the Grand National Assembly of Turkey (TBMM) for millions of workers who became insured after that date, missed the EYT regulation, and, despite completing their premium days, were caught by the strict age requirement. Chief Social Security Expert İsa Karakaş explained the critical details of the 3-article phased retirement bill referred to the Planning and Budget Committee.

A PATH TO RETIREMENT WITHOUT AN AGE REQUIREMENT FOR THOSE WHO MISSED EYT

According to the information provided by Chief Social Security Expert İsa Karakaş, the first article forms the heart of the proposal submitted by the opposition. "Temporary Article 113," planned to be added to the Social Insurance and General Health Insurance Law No. 5510, covers SSK, Bağ-Kur, Agricultural SSK, and Pension Fund members who became insured for the first time after September 8, 1999.

Under this article, citizens who have completed their insurance period and number of premium days are envisaged to be granted an old-age pension directly, without an age requirement, if they apply in writing. The main purpose is to grant a fair retirement right to the masses who have difficulty finding work due to their age and who are pushed out of the system despite having completed their premiums.

IT WILL ENTER INTO FORCE ON THE DAY IT IS PUBLISHED IN THE OFFICIAL GAZETTE

The second article of the proposal aims to prevent bureaucratic delays after the legislative process. According to the bill, the law will enter into force immediately as of the day it is published in the Official Gazette. Karakaş summarizes the rationale for this rapid step as the citizens no longer having the patience to wait and the principle that "delayed justice is not justice."

EXECUTIVE AUTHORITY WILL REST WITH THE PRESIDENT

The third article, which provides legal assurance, directly gives executive authority to the President. İsa Karakaş emphasized that the immediate enactment of this bill—which also observes the actuarial balances of the Social Security Institution (SGK) and includes a fair phasing according to insurance start dates—is the common expectation of millions.
