The Court of Cassation 2nd Civil Chamber found the man fully at fault for telling others about events concerning family privacy in the divorce case, failing to meet the needs of the common residence, and insulting his wife. The High Court ruled that the man's divorce case should be dismissed and the woman's case should be accepted.
The divorce case filed mutually by the couple Verda and Peyami N. in Trabzon came before the 2nd Civil Chamber of the Court of Cassation after different fault assessments between the courts.
In the file, especially the disclosure of private marital events to relatives and other people was one of the decisive factors in the fault assessment.
FIRST COURT FOUND THE MAN HEAVILY FAULTY
According to the news in Türkiye Gazette, the Family Court in the Kelkit district of Gümüşhane assessed the behaviors of the parties that caused the fundamental shaking of the marital union.
The court concluded that the man told others about events concerning family privacy, gossiped about his wife with his relatives, and did not meet the needs of the common residence. It was determined that the woman did not admit her husband to the common residence. For these reasons, the court found the man heavily faulty and the woman slightly faulty and decided on the couple's divorce.
THEIR CONTINUING TO LIVE IN THE SAME HOUSE WAS CONSIDERED "FORGIVENESS"
Upon the husband's appeal regarding alimony, the file was moved to the 1st Civil Chamber of the Trabzon Regional Court of Appeal.
The Regional Court of Appeal considered the couple's continuing to live together after some of the events subject to the case as "forgiveness." Additionally, considering that the woman did not let her husband into the house, it deemed the woman fully faulty.
Thus, the fault assessment in the first-instance court changed in favor of the man.
THE COURT OF CASSATION OVERTURNED THE DECISION
The 2nd Civil Chamber of the Court of Cassation, which examined the file upon the woman's appeal, did not find the Regional Court of Appeal's fault assessment appropriate.
The High Court took into account that the man, during the marriage, continuously told others about events concerning family privacy, did not meet the needs of the common residence, and insulted his wife. Due to these behaviors, it was ruled that the man was fully faulty.
THE MAN'S CASE WILL BE DISMISSED
The Court of Cassation overturned the Regional Court of Appeal's decision, ruling that the divorce case filed by the man should be dismissed, while the divorce case filed by the woman should be accepted. The man's appeal objections regarding alimony were also not accepted.
The decision once again revealed that sharing private marital events between spouses with third parties in divorce cases can be considered against the spouse in the fault assessment.
